ICANN은 2007년 gTLD에 대한 수요를 충족시키기 위하여 신규 gTLD가 도입될 것을 제안하였고 현재 신규 gTLD를 생성되기 위한 1라운드가 진행되고 있다. 신규 gTLD를 생성한다는 것은 자신이 희망하는 문자열을, 자신이 희망하는 언어에 따라 최상위 도메인을 생성할 수 있다는 것을 의미한다. 이에 의하여 인터넷 커뮤니티에게 인터넷 공간활용을 위한 다양성이 제공되고 비즈니스를 위한 기회가 더 제공된다. 그런데 신규 gTLD는 생성과정과 생성 이후에 한국의 국익이나 국민감정을 손상하거나 한국인의 권리를 침해할 수 있으며, 한국인의 상표나 상호를 이용하여 신규 gTLD로 생성되기 위하여 신청됨으로써 한국인의 권리가 침해되거나, 신규 생성된 gTLD 관리기관이 한국인의 권리를 침해하는 방식으로 gTLD를 운영할 수도 있다. 따라서 한국 정부 및 한국인 권리자는 신규 gTLD 생성과정에서 적극적으로 이의를 제기하거나 생성 이후 분쟁해결절차를 적극적으로 활용할 필요가 있다. 이 글은 신규 gTLD와 관련된 이의제기 및 분쟁해결에 대하여 상세히 고찰하고, 이의제기와 분쟁해결이 국내법상의 분쟁해결 규정에 어떠한 영향을 미치는지, 이에 따라 정부 차원에서 어떠한 정책과 입법을 마련할 것인지를 논의하고 민간기업 차원에서는 어떻게 대처하여야 할 것인가를 고찰하였다.
Abstract
In 2007, ICANN approved a new gTLD program, and it announced that it would introduce new gTLDs. It said that the introduction of new gTLDs would foster cohice and competition in domain registration services, and that it is significant to the promotion of ICANN's core values. In January, 2012, applications for new gTLDs began, and they are now under evaluation. While the new gTLD will give an opportunity for online innovation and new business, it might harm interests of both Korea and Koreans. For example, the applicant may use gTLD strings that are identical or confusingly similar to the other's mark. The Registry operator may operate gTLDs in a way that is detrimental to the interests of trademark owners. The gTLD Applicant Guidebook provides some measures designed to protect those interests: opposition and dispute settlement procedure. This paper deals with the opposition and dispute settlement concerned with the introduction of new gTLDs. It suggests some strategies that Korea should follow, and suggests legislative proposals.
