우리나라에서 청구보증의 이용실태와 동 보증제도의 활성화 방안에 관한 연구

The global construction industry is expected to grow at over 7% annually for the next 5 years. As the industry grows, so does the request for a demand guarantee in Korea where the applicant receives more orders from the beneficiary. A demand guarantee is an irrevocable undertaking issued by the guarantor upon the instructions of the applicant to pay the beneficiary any sum that may be demanded by that beneficiary up to a maximum amount determined in the guarantee, upon presentation of a demand complying with the terms of the guarantee. In order to proceed with a project received from the beneficiary, the applicant should provide the beneficiary with a demand guarantee within a given time, otherwise the former would not be given an opportunity in the first place. In Korea, large companies are relatively easy to receive a demand guarantee from the guarantor thanks to their strong financial status while small and medium sized enterprises(“SMEs”) have difficulty obtaining it. So this paper tries to find out problems that SMEs are facing in securing a demand guarantee in Korea and seek out things that need to be improved so that they can obtain it easier than now. This paper addresses not only the current state and problems of using a demand guarantee in Korea, but also ways to increase the usage of a demand guarantee by providing opinions that can also contribute to a wide utilization of the URDG758 in Korea.
