프랑스 건축공법의 현황과 쟁점 ― 도시계획을 중심으로 ―

초록
본고는 도시계획법을 중심으로 프랑스의 건축공법 전반을 개관하는 것을 목적으로 한다. 이를 위해 건축공법을 건축경찰법, 도시계획법, 도시개발법, 주택법 이상 4가지 유형으로 구분하는 일반이론을 제시하고, 각 유형별로 우리 법과 프랑스 법을 비교하는 분석을 시도한다. 그런 후에 프랑스의 도시계획법을 구성하는 각각의 제도를 우리 법의 관점에서 직관적인 이해가 가능한 용어와 체계를 사용하여 설명한다. 이를 통해 글로벌 스탠더드에 견주어 보았을 때 우리 건축공법의 현재 부족한 점 그리고 우리 건축공법에서 우선적으로 개선해야 할 점이 드러난다. 본고는 그중에서도 특히 토지이용규제의 통합적 관리에 주목한다. 프랑스의 경우에는 시민들의 자유와 재산에 직접적으로 영향을 미치는 모든 토지이용규제가 단일한 체계 안에 편입되도록 설계되어 있어서 시민들로서는 자신에 대한 토지이용규제가 무엇인지를 쉽게 알 수 있지만 우리의 경우에는 그렇지 못하다. 이는 단순히 시민들에게 제공되는 정보의 차이를 야기하는 데 그치지 않고, 행정이 자신의 임무를 효과적으로 수행하는 데 있어서도 적지 않은 차이를 가져온다는 것이 본고의 문제의식이다.
Abstract
This article aims to make a general overview of French construction regulations law, concentrating upon land use planning law. Construction regulations law can be divided into four categories-building code, land use planning law, land development law, housing law. This paper compares French law with Korean law by categories and explains each institutions of French land use planning law by using terms and frames that can be understood intuitively from Korean law viewpoint. This process clarifies the shortcomings and improvements in priority of Korean construction regulations judging from Global Standards. This article focuses on, inter alia, the integrated management of land use regulations. In France, all land use regulations that affect civil liberties and properties directly are programmed to be incorporated into the unique system. For that reason, french citizens can easily recognize which regulations apply to them. But in Korea, it's not. It is supposed that this situation would cause public administrators serious difficulties in performing their missions effectively, as well as brings about unequal distributions of information among citizens.
