초록
이 논문에서는 2011년도에 선고된 국세기본법 분야의 판례 중에서 중요하다고 생각되는 13개를 골라서 검토하였다. 판례의 평석은 대상판결의 사실관계를 요약하여 쟁점을 제시하고 판결요지를 소개한 후 해설을 덧붙이는 방식으로 하였다. 검토대상인 13개의 판결 중 무려 10개의 판결이 파기되었을 정도로 대법원이 하급심과 다른 관점에서 세법을 해석하고 적용하였다. 그 중 금지금 변칙거래에서 매입세액의 공제․환급을 구하는 수출업자에게 신의성실원칙을 적용하기 위한 요건을 최초로 제시한 전원합의체판결(대법원 2011. 1. 20. 선고 2009두13474 전원합의체 판결), 세무조사결정에 대하여 항고소송의 처분성을 인정한 판결(대법원 2011. 3. 10. 선고 2009두23617, 23624 판결)은 선례로서의 의미뿐 아니라 과세실무에도 큰 영향을 미치는 매우 중요한 판결로 평가된다. 그 밖의 판결들 중에는 기존의 입장을 재확인한 것도 있지만 구체적 사실관계를 법률에 적용하거나 법리를 전개함에 있어 선례로서의 가치를 가지는 것도 상당수 있다. 전체적으로 보면 납세자의 권리구제에 기여할 수 있는 판결과 함께 과세권의 적정한 행사를 중시한 판결이 다수 선고되었고, 세법의 형식적 해석에 얽매이지 않고 다른 조항과의 유기적 관계, 입법취지 등을 고려하여 구체적 타당성 있는 결론을 도출하기 위한 해석이 이루어져서 조세법의 발전에 기여하였다고 평가할 수 있다.
Abstract
This article aims to review and examine the important judgements concern- ing Framework Act on National Taxes delivered by the Supreme Court in 2011. This paper deals with 13 cases. Annotation of cases are composed of summary of fact, issue, the substance of ruling and comment. The Supreme Court interpreted and applied the law in a different view than the lower court did, and annulled the original decisions in 10 out of 13. What is specially noteworthy among them are 2 cases. One is the full bench decision which applies the principle of faith and trust in terms of taxpayers to exporters of gold bullion(Jan. 20, 2011；2009du13474) and the other is the decision which regards a tax inspection as a kind of administrative measure(Jan. 20, 2011；2009du23617, 23624). These 2 cases function as precedent and have a great effect on tax practice. Besides there are important cases which have meaning of precedent. Be taken altogether, the Supreme Court laid emphasis on right of tax office as well as taxpayer's rights and tried teleological getting away from formal interpretation in some cases.
