이민자지위와 범죄심각성이 피해신고에 미치는 영향

본 연구에서는 이민자와 원주민 간에 범죄피해신고율의 차이를 조사하고자 하였다. 도널드블랙(Black, 1974)의 이론과 선행연구 결과들을 바탕으로 이민자의 범죄피해신고율이 원주민에비해 낮다는 가설을 검증하였다. ‘국제범죄피해자조사’ 자료를 분석한 결과 단순절도, 주거침입절도, 폭행, 강도 등 네 가지 범죄피해 유형 중 강도피해의 경우에 있어서만 이민자 지위가범죄피해신고율과 유의한 부적(-) 관계를 나타냈다. 선행연구들과 마찬가지로 피해심각성은범죄피해의 유형에 관계없이 신고율에 가장 큰 영향을 미쳤으며, 피해가 심각할수록 경찰에신고할 가능성이 증가하는 것으로 나타났다. 마지막으로, 강도피해의 심각성 수준에 따른 이민자 지위와 피해신고 간의 관련성을 조사하였다. 강도피해가 중간수준에 해당하는 ‘심각한 편’인 경우 이민자와 원주민 간의 범죄피해신고율이 가장 큰 차이를 보였다. 피해가 매우 심각한 수준일 때에도 이민자의 신고율이 높았지만원주민과의 신고율 차이는 피해가 심각한 편인 경우보다는 적었다. 반면, 피해가 심각하지 않을 때에는 두 집단 간의 범죄피해신고율 차이가 거의 없는 것으로나타났다. 정책적 함의로서 형사사법시스템에 대한 이민자들의 접근성을 향상시키는 방안과이민자들이 지역사회의 구성원으로서 제대로 정착하고 원주민과 융화하기 위한 선결조건에 관해논의하였다.
Abstract
This study aims to investigate the differences between immigrants and natives in their decisions to call the police to report crime. Drawing upon Donald Black's (1974) theory and the empirical findings of previous studies, it is hypothesized that immigrants are less likely to report crime to the police than natives when they are victimized. The results show that immigrant status is inversely related to crime reporting only for robbery victimization. Seriousness of crime is the strongest predictor and is positively associated with crime reporting. The difference in crime reporting between immigrants and natives is greatest when crime is fairly serious. The degree of difference decreases when victims perceive crime as very serious. On the other hand, the likelihood to call the police is not different for non-serious crime. Finally, policy implications are discussed including the strategies to provide immigrants with a better access to the criminal justice system and the prerequisites to embrace immigrants as members of our society.
