출판물에 의한 명예훼손죄에 있어 정보제공자·편집책임자·언론사(법인)의 형사책임

초록
언론사는 기사내용의 정확성을 검증하고 공익성 여부를 판단한 후에 보도하여야 할 책임과 의무가 있다는 점과 독자적 편집권을 가지고 있다는 점에서 판례가 출판물에 의한 명예훼손죄가 간접정범의 방식에 의해서 성립하며 그 결과 피이용자인 언론기관은 불가벌이 된다고 결론을 내린 것은 적절하지 못하다. 나아가 언론사와 편집 책임자의 책임을 분리하여야 할 것이다. 따라서 언론사가 정보제공자로부터 기사를 받았다고 하더라도 편집책임자에게 비방의 목적이 있는 경우에는 제309조가 적용되어야 하며, 비방의 목적이 없는 경우에는 제307조가 적용되어야 한다. 이때 기사를 제공한 자는 공동정범, 교사범 또는 방조범의 책임만을 지게 된다. 반면 언론사는 편집책임자를 관리 감독하는 지위에서 그러한 구성요건적 결과발생을 방지하지 않은 책임이 있는 경우 부작위에 의한 공범 성립을 검토하는 것이 타당하리라 본다. 요컨대, 출판물에 의한 명예훼손죄의 경우 정보제공자 뿐만 아니라 편집책임자, 언론사를 세분화 하여 각각의 형사책임을 논하는 것이 형법의 자기책임 원칙과도 조화를 이루는 것이며, 나아가 언론사의 객관적이고 책임성 있는 보도라는 관점에서도 합리적이라 생각을 한다.
Abstract

Therefore, the purpose of spamming to the editor, if any, should be applied to criminal code 309, otherwise the penal code 307 shall apply. In this case, the article should be punished as an accomplice to the submitter. Another media company to manage the editor is in a position to supervise. Therefore, the editor of the media companies to prevent a crime if, and the media should also be punished as an accomplice. Therefore, In the case of libel by publication, articles informer, editor, and the media to distinguish between criminal law and criminal liability argue is consistent with the principles of self responsibility.
