NEIS에 의한 교육정보의 공개와 학생의 개인정보 보호

The purpose of this article is to suggest that would protect personal information in public sector and National Education Information System(NEIS). It is against the Constitution that the authorities collect and use personal information on the NEIS without a legal basis or approval of the personal concerned the information. Usually, the official information disclosure is for the people’s right to know. but the education records public announcement is for student and parent’s right, such as right to know, right to learning, right to choice on school, and so on. Korea has a comprehensive data in public sector by the law. It is “the Act on the Protection of Personal Information of 2011”. But it is not enough to protect the personal information and the protection of student’s personal information has become an important issue with progress in the utilization of information technology for educational purpose. So, In this article, I reviewed the background, purpose, and content about the NEIS and the related education codes. And examine the probleme of NEIS and the educational codes that is focused on the educational legal system, the rights on the Constitution. First, I researched the I review the background, purpose, problems and content about the NEIS and the educational laws relating to NEIS. Second, I reviewed the other country’s educational legal system to protect personal rights of students. Finally, I suggested the several legislative direction and educational system to solve the problem how to protect student’s personal information.
