최근 들어 기상이변 등 엄청난 규모의 자연재해가 발생하면서 그 원인 중의 하나로 기후변화의 문제가 자주 논의되고 있다. 그와 관련하여 적절한 정책의 개발 및 추진뿐만 아니라, 민사법적 측면에서 기후변화로 인한 환경책임소송도 점차 주목을 받고 있다. 특히 이산화탄소를 비롯한 온실 가스의 배출문제가 점차 선진국을 중심으로 중요한 이슈로 등장하고 있다. 기후변화에 따른 지구온난화가 계속될 경우에 남태평양에 위치한 투발루의 자취가 사라지게 될 것이라는 우려가 나오는 시점에서, 2002년 투발루와 이누이트족은 지구온난화의 주요원인을 제공한 미국과 오스트레일리아 등을 상대로 소송을 제기하는 상황에 이르게 되었고, 앞으로 기후변화에 기인한 소송이 어떻게 진행될지의 문제는 세계적인 관심의 대상이 되고 있다. 2009년 12월 코펜하겐에서 열린 기후변화협약 당사국 총회에서 세계 100여 개국 정상은 ‘교토의정서’ 이후를 대비한 협약 체결을 시도했지만, 온실가스 배출 규제를 둘러싼 각국의 이해관계와 인식 부족 등으로 구속력 있는 합의 도출에 실패했다. 원래 환경침해에 따른 소송은 관청이나 국가를 상대로 이루어졌으나, 점차 기후변화와 지구온난화의 주범인 이산화탄소(CO2)를 많이 배출하는 대기업을 상대로 한 손해배상소송이 증가하고 있다. 이러한 환경소송으로 인한 배상책임의 문제는 자동차 및 에너지산업 그리고 책임보험업자 등 기업에게도 커다란 부담으로 작용하고 있다. 최근 미국 항소법원들의 판결은 장차 기후변화가 기업에 대해 새로운 책임요인으로 중요한 의미를 가질 수 있다는 점을 보여주고 있다. 이러한 관점에서 이산화탄소의 배출과 관련한 미국에서의 소송들에 관하여 살펴보고, 이산화탄소 배출에 기인한 손해배상소송의 법적 문제를 검토하는 것은 적지 않은 의미가 있을 것이다.
Abstract
The article deals with the environmental responsibility caused by climate change. Of course, concrete scientific evidence is lacking. There are disscussions about Carbon dioxide and other greenhouse gas emissions regulations, but it's not enough, to identify some chemical processes through the global warming that also in the long term global temperature change and carbon dioxide causes the correlation between the degree of emission and damages. These environmental risk of legal liability due to lawsuits to be a burden to firms such important legal issues, coupled in particular the automotive industry, energy industry, and exacerbates the risk of potential liability insurers are too. In a recent U.S. Court of Appeals ruling of the company for future climate change as a new liability risks could have serious implications has shown that. From a legal point of view, liability for damage caused by climate change and an introduction to the legal issues will be reviewed. In this context, it is mentioned that the automotive industry, energy industry and let the insurer responsible for potential risks and countermeasures to explore.
