미래인터넷 법제의 전망과 과제

Perspectives and Tasks of the Legal Framework on the Future Internet

The current Internet designed 40 years ago is today the most important evolving information, service and networking infrastructure providing the mechanisms for the digital society to function as an integrated entity enabling sharing, contributing, creating, using, collaborating and integrating information and knowledge by all. But the current Internet has been founded on the basic architectural premise, that a simple network service can be used as a universal means to interconnect intelligent end system. This simple premise has allowed the internet to reach an impressive scale in system of interconnected devices. However, This simple premise has a problems that the current Internet would reach soon both its architectural capability limits and its capacity limits. These problems have gained prominence in the world’s media since they are most directly linked to the political and regulatory spheres. Other issues are centered on the fact that the Internet was originally designed in a very different context and for different purposes than it is used today. All actors involved in the internet are now actively discussing to limitations of the current Internet architecture as well as its potential evolution. Indeed,despite ongoing efforts, no satisfactory solution is currently available or even exists to address altogether the challenges experienced by the Internet and its evolution. Despite all the uncertainties regarding architectures, protocols and technologies to be used in an Internet of the future, it is clear that it will be shaped of humans, carrying with it major social and economical impact. This article describes a few highlights of the Internet development in the past,analyzes some of the policy factors at work in that development, and suggests some avenues for academic contributions to the successful evolution of the future Internet.
