초록
국제재판상 증거로 제출된 지도에 대한 증거력(증거가치, 증명력) 인정 여부 문제는, 연혁적으로 그것을 완전히 부정하는 전통적인 자세에서, 지금은 1차적 직접증거 대신 2차적 간접증거 다시 말해 마지못해 부차적 정황증거로서의 지위까지는 긍정하게끔 되었다. 한편, 지도의 증거력 문제는 승인과 금반언의 원칙 그리고 이른바 후속적 관행의 문제와 연관되어 있음은 분명하다. 그리고, 지도증거와 관련된 쟁점에서, 본 논문의 주된 소재인 카시킬리/세두두 섬 관련 사건에서는 두 당사국 중 나미비아의 적극적 공세 입장과 보츠와 나의 소극적 수세 입장이 극명히 대비된다. 당해 사건의 사법적 판단과는 별개로, 판결문 본문과 별개의견 및 반대의견 등을 통틀어 각각의 해당 판사들마다 증거로 제출된 지도의 증거력을 평가할 때 그 개성의 두드러짐 또한 명확하다. 마지막으로, 최근 들어 증거로서의 지도의 증거력에 관하여 의미 있는 변화의 조짐이 보이는데, 이것은 국내법상 지도의 증거력에 대한 전향적 자세와 지극히 정밀하고 비편파적인 전자지도의 등장과 함께하고 있다.
Abstract
The attitude toward how to see the value (=weight or force) of the maps submitted as evidence in the process of international legal proceedings has developed from a total 'denying' to reluctantly accepting them as auxiliary and circumstantial ones. Apparently, the problems of recognition including acquiescence, Estoppel principle, and so-called 'subsequent practices' are to be considered with 'the value'. While Botswana took its passive and defensive way, it is observed, in dealing with the issues of evidentiary values of the maps submitted in the Case Concerning Kasikili/Sedudu Island, Namibia chose the opposite way; that is a positive and offensive one . And, besides its Judgement, every ICJ judges have also shown their own more-or-less different characteristics regarding 'the issues'. By the way, a new tendency change in the international level to gauge the weight of map evidence has been being evidently expected somehow in a way of emergence of the currently changing attitude in evaluating 'the value' in national level of judicial proceedings and of extremely accurate and totally non-biased digital map based upon so-called GPS as well.
