준법교육의 의의와 한계에 관한 고찰

준법교육을 법규와 사회 보편 가치를 준수하고 이에 따라 행동하기 위해 시행되는 직간접적인 모든 교육활동으로 전제한다면, 현재 법교육은 준법교육이 강화되는 경향을 보인다고 말할 수 있다. 이와 관련하여 다양한 논문에서 준법교육의 의의와 한계를 주장하고 있으나, 특정 입장만을 전달하거나 추상적인 담론만을 제기하고 있다. 따라서 학습자의 심리적 측면과 교육적 본질 측면에서 준법교육의 의의와 한계를 공정하고 면밀하게 고찰해 본 결과, 준법교육의 성과와 한계를 다음과 같이 정리해 볼 수 있었다. 우선 준법교육은 비행 청소년들의 재범률을 낮추고, 범죄와 비행을 예방하는 효과가 있었다. 또 준법교육은 학습자들의 법 관련 인지능력과 사회적 기능을 신장시키거나 법체계와 법질서에 대한 긍정적인 가치․태도를 형성하게 하는 데에도 효과가 있는 것으로 나타났다. 하지만 이러한 성과에도 불구하고 도덕성 발달론, 법인지 발달론, 인지부조화 이론과 같은 심리학적 측면의 이론에 따르면 일부 학습자에게는 단순히 규칙 준수를 강요하는 방식의 교육이 준법의식 형성에 무용한 경우가 있을 수 있다. 나아가 교육적 측면에서도 가치교육의 입장이나 법교육의 본질관에 비추어 볼 때, 준법교육은 가치 내면화에 취약할 수 있고 법교육의 목표와 성격을 완전하게 구현하지 못하는 등의 한계를 가질 수 있다. 따라서 준법교육은 법교육의 일부 영역에 해당한다는 위상을 인식하여 준법교육의 성과는 극대화시키되, 이러한 한계를 뛰어넘을 수 있는 입법교육이나 헌법재판교육 등의 대안적 교수-학습방법이 법교육에서 활성화되어야 할 것이다.
Abstract
If a compliance education can be regarded with educational activities that carry out compliance with laws and universal values directly or indirectly,recent LRE(Law-Related Education) is thought to be inclined to compliance activities. In a compliance education, the significance that we ought to concentrate on are : to prevent crime and delinquency more effectively; to reduce the recidivism rate of juvenile delinquents; to enhance the learner’s cognitive abilities about the law and order; to promote social skills such as personal relations, decision-making abilities and so on; to cultivate attitudes and values that is related to law systems and orders. Despite these achievements, a compliance education also has some limitations in terms of psychological and educational aspects. First, some students who simply forced to comply with the rules of the law can be one of the useless case in internalizing pro-social values. Second, citizenship education is beyond cultivating compliance with law and social values. After all, alternative LRE such as law-making education, judicial review education are added to a compliance training activities.
