가족접견제도의 개별화 : 가족만남의 집을 중심으로

초록
가족접견제도는 배우자와 자녀 등과 같이 인생에서 의미 있는 사람들과의 유대를 강화시킬수 있고 이들과의 관계를 유지하여 가족관계를 안정시킬 수 있어 수형자가 사회복귀를 하는데중요한 역할을 할 수 있다는 긍정적인 측면이 많다. 그러나 보안상의 위험, 비용증대 그리고가족접견장소를 통한 마약, 흉기 등과 같은 반입금지물품의 유입 등의 부정적인 측면도 있다. 특히 가족간의 문제가 있었던 수형자들에게는 이러한 접견제도는 오히려 악영향을 미칠 우려가있다. 수형자가 입소 전에 배우자와 좋지 못한 관계였을 경우에는 교도소 내에서의 접촉이 부정적 영향을 줄 수 있다는 것이다. 현재처럼 대상자를 구체적인 가족관계를 고려하지 않고 선정하는 것은 현대교정이 요구하는 개별처우에 부합하지 못한다는 문제점이 있다. 그러므로 수형자개개인의 특성에 맞는 개별화된 가족접견제도를 모색하여야 한다. 가족접견제도를 개별화하기하기 위해서는. 먼저 수형자와 그의 가족, 친밀한 배우자, 친밀하지 않은 배우자, 자녀들, 그리고 그 외의다른 가족들에게는 접견의 종류, 방법 등이 각각 다르게 개별적인 접근을 하여야 한다. 수형자,배우자, 그리고 자녀들이 받는 악영향도 고려하여야 하기 때문이다. 그리고 수형자의 성별에따른 가족접견제도를 검토하여야 한다. 수형자가 아버지인지 어머니인지에 따라 자녀들과의가족접견에서 오는 영향이 다르기 때문이다. 가족접견의 대상자로서 치료감호대상자, 과거 가정폭력범죄자, 성병 등 전염성 질환자를 제외 시켜야 한다. 마지막으로 가족접견의 장점을 살려법정 가족은 아니지만 수형자에게 법정가족 이상의 의미가 있을 수 있는 사실혼 배우자나 동거자에게도 가족접견의 대상에 포함시켜야 한다.
Abstract
Family visits system is able to strengthen ties with people such as spouses and children that have meaning in inmates' life. Stabilizing relationships with family,Family visits can play an important role to return the inmates to society. There are many positive aspects of this system. However, its side effects can not be ignored. In other words, it may result adverse effects : a security risk, cost increases and the influx of prohibited goods such as drugs and offensive weapons over the family visits place. Rather, family visits can give bad effects to prisoners especially those who have problems between family. To prisoners who was a bad relationship with his spouse before the admission, meeting in prison can affect negatively. The way to select subjects as prison without taking into account of family relationship, as now, does not meet the individual treatment that modern correction needs. Therefore, according to the characteristics of the individual inmate,individualized family visits system should be sought. To individualize family visits,First, inmate, intimate partner, not intimate spouse, children and other family members should be approached in different types and methods of family visits. Because we should consider adverse effects that inmates, spouses, and children receive. And the family visits based on gender shall be reviewed. Depending on whether Inmates are father or mother, the impacts from family visits are different. As the subject of family visits, the subject in medical treatment and custody, the perpetrators of family violence in the past and contagious illness including venereal disease should be excluded. Finally, taking advantage of family visits, person living with or common-law partner who is more meaningful than legal family be included in the subject of family visits.
