몽골 부동산관련 법제의 동향에 관한 연구

The purpose of this study is to examine of the real estate-related laws in Mongolia. The study also explores disharmony of mutual relationship among the real estate-related laws in Mongolia. Mongolia is introduced a rapid process of democracy and market economic system As well as due to the land is the property of the country of Mongolian culture and their traditional way of thinking, there are many problems relating to real estate laws. The Land use-related laws, Civil law and other major environmental laws were enacted at about the same time in the middle of 1990s, in many cases with foreign assistance provided by donor agencies and international organizations such as the IBRD, ADB and UNDP. Because of these facts has resulted in a complex of legal concepts, measures and mecanisms which are ill-defined and ambiguous or alien to Mongolian tradition and regal culture, and created institutions with overlapping or conflicting jurisdictions, making it difficult to implement and enforce the provisions of the law. The fields of study in this article are the rules of Constitution and Civil Law relating to real estate, land use-related laws, Environmental Protection Laws and main provisions of Housing Act. So I believes that it is important to take careful look at the existing system of environmental and real estate-related laws as well as promote coincidence of mutual relationship among the real estate-related laws.
