건설 하도급공사 계약보증 개선방안 연구

Since the advent of new material and new methods with industry development, by combining the these material and methods with construction industry, construction itself are very complicated and multi-functional. Subcontract bond which guarantees the implementation of subcontractor has an effect on the relationship of subcontract parties. The possibility has increased that some contractors regard subcontract bond as a penalty instead of an estimated amount of damage. If subcontract bond is abused, then subcontractor and bond company fall into a dangerous situation. So, the research for subcontract bond should be started. Therefore, to maintain the sound subcontract order, prevention of subcontract bond claim abuse, perfect conformity of contract and bond claim, prevention of deforming subcontract conditions in the legal aspect and bid & contract aspect, are suggested in this study.
