법조직역 진출의 관점에서 본 법실무교육의 내실화와 지향점

Success of the law school as a new lawyer training system (hereinafter referred to “law school”) is closely related to enrichment of legal in-service education. The switchover from the traditional lawyer training system to the law school is the choice of a plural system in which lawyer training centers around the law school. The lawyers trained in the law schools established through such a system change should at least have more competitiveness than the lawyers born in the traditional system who were trained in the Judicial Research & Training Institute after passing the judicial examination. In this aspect,such a fundamental switchover or paradigm shift of lawyer training system is definitely a great new challenge. In order to meet the nationwide expectation for successful stabilization of law school, it is absolutely necessary to continuously complement the problems inherent in the law school system and incessantly make efforts to improve the system. Only such interception of vicious circles and promotion of virtuous circles will guarantee the success of the law school system. A great problem is that law school training is designed in the manner suitable for the traditional practice-oriented lawyer traing system. The law school education program is required to be enriched so that most of the lawyers graduating from law schools may meet the needs of expanded legal circles such as in-house counsels, government authorities, etc. In this viewpoint,this study reviewed the civil and criminal cases training programs which are provided by the Judicial Research & Training Institute during vacations to support law schools, and tried to find the matters to be improved. It is probably difficult to train the good lawyers required in the 21st century only through education at law schools. In addition to the basic legal in-service education at law schools, they shall have to get comprehensive practice capabilities through training programs well designed by various specialized practice research and training institutes, practice support programs given by the Judicial Rearch & Training Institute, enriched in-depth lawyer training after passing the examination for the bar, etc. Such a series of processes will ensure birth of a lawyer of good moral character, high specificity and creativity complying with the purpose of the law school system.
