미국의 뇌물, 부정청탁 및 이해충돌방지법에 관한 연구

최근 들어 우리사회에 고위 공직자들이 퇴임하고 민간기업 등으로 전직하는 사례가 증가함에 따라 공무원이 재직 중 또는 퇴임 후 자신이 취급하던 사무에 부정한 청탁을 하는 행위가 늘어가고 있다. 더 나아가서 자신이 직접 취급하지 않았더라도 자신이 영향력을 행사할 수 있는 사무에 관여하여 부정한 청탁을 하거나, 다른 경쟁자에게는 공정하지 않은 계약 또는 거래를 성사시킴으로써 우리 사회에서의 공정한 룰을 위반하고 결국 이는 정의롭지 못한 사회를 만드는 주범으로 인식되고 있어 해당 행위를 범죄로 규정, 강력히 처벌해야한다는 인식이 국민들로부터 공감대를 얻고 있다. 최근 국민권익위원회는 공무원들이 직무상 발생하는 이해충돌행위를 방지하고, 기존의 뇌물죄로 처벌할 수 없었던 청탁행위를 강력하게 처벌하기 위해 ‘부정청탁방지 및 공직자의 이해충돌방지법안’을 입법예고한 바 있다. 본 연구는 뇌물, 부정청탁 및 이해충돌에 관한 법 제도(Conflict of Interest Legislation)가 가장 다양하게 규정된 것으로 알려져 있는 미국의 법제도 및 판례의 경향을 살펴보고 우리나라에 주는 시사점을 얻는데 그 목적이 있다. 아울러 미국 각 주들 중 우리나라에 시사점을 줄 수 있는 텍사스, 몬타나, 메인주의 부정청탁 관련 규정을 소개한 뒤, 국민권익위원회가 입법예고한 ‘부정청탁방지 및 공직자의 이해충돌방지법안’에서 반영하여야 할 법제를 살펴본다.
Abstract
It has been recent phenomenon in Korea that as much more retired high public officials are getting employed by private enterprises for their competitive professional careers, those former officials try to influence improperly their former colleagues who work for the Korean Government violating the rule of justice leading Korea to an unjust society. Therefore, it gains consensus among Korean people that the Korean Society needs to punish heavily those public officials who commit corrupt acts, such as illegal gratuity, improper influence, conflict of interest, for which, however, the Korean Penal Code has not provided any specific provisions to apply. Recently, thus, the Korean Anti-Corruption and Civil Rights Commission is timely drawing up a new bill to punish current and former public officials who, for example, improperly influence other public officials taking advantage of their former public status. This paper aims to elaborate on the conflict of interest legislation of the United Statutes, which has been known to be specific and comprehensive. Part II explains bribery and illegal gratuity statutes of the 18 U.S.C. 201. Part III illuminate on the conflict of interest statutes of the 18 U.S.C. 203, 207, 208, and 209. Part IV reviews conflict of interest statutes of Texas, Montana, Maine. Based on the analysis, Part(Ⅳ) provides some insights for Korean conflict of interest legislation.
