지식재산으로서의 모바일 UI 디자인의 법적 보호

As the advancement of information technology and digital technique brought many complicated and diverse changes to the function of ordinary products in our everyday life, the User Interface design having a key part in the function of interface between these products and human-being is getting more and more important. Some companies are investing manpower and expense in the development of UI Design separately apart from the appearance design of product in order to take a high position from competitive market. Recently, In global patent dispute centered in Apple Inc. the issues of technical patent, design patent, the trademark and trade dress which relate with UI designs are discussed actively as controversial subjects. At this critical juncture, the present research question emerged from the questions: whether UI design is protected fully or not according to domestic law. So, this paper examines the issues of the law related with UI designs. The aim of this study is to provide an necessity of criteria for evaluating design similarities, judgement of design copy, average design standard, protection of design concept, and so on.
