대토보상제도의 개선방안에 관한 연구

대규모 공익사업의 추진은 필연적으로 재산권에 대한 제한을 수반하게 되고, 이에 따른 정당보상의 문제는 국가적으로 해결해야 할 과제가 되고 있다. 그 동안 주로 시행되어 온 전면수용방식과 이에 따른 보상방법은 피보상자들의 대체토지취득이나 재정착을 불가능하게 하고, 보상자금이 인근지역 부동산으로 유입되면서 주변 토지가격을 앙등시키는 심각한 사회 문제를 야기하고 있다. 따라서 부동산폭등억제, 원주민의 재정착 제고 및 개발혜택의 공유를 위해서는 현재의 사전보상․현금보상에서 채권보상이나 현물보상을 활성화하는 방향으로 토지보상방법의 변화가 요구된다. 이에, 정부는 2007년 10월 17일, 「공익사업을 위한 토지 등의 취득 및 보상에 관한 법률」일부개정을 통해 대토보상제도의 근거를 마련하였으나, 일종의 사후(事後)보상적 성격 때문에 헌법상 정당보상의 원칙에 위배된다는 주장이 제기되고 있고, 입법적 불비 등으로 인해 대토보상 시행실적은 기대에 미흡한 수준이다. 대토보상은 다양한 토지보상방법 가운데 하나일 뿐이지만, 실효성만 확보된다면 각종 공익사업으로 인한 수용보상금 부담을 완화할 수 있고, 동시에 토지보상금이 지역사회 발전 사업에 재투자되는 효과가 있을 것이라는 점에서 주목할 제도임은 분명하다. 따라서 대토보상이 헌법상 정당한 보상의 원칙에 위반되지 않는다는 명확한 법논리를 정립해야 할 것이며, 동시에 피수용자들을 대토보상으로 자발적으로 유인할 수 있도록 법적 미비점을 개선하려는 다각적인 노력이 요구된다.
Abstract
Up to date, two types of land development have been used. one is the compulsory purchase by the eminent domain and the other is the land substitution by land readjustment project. The land substitution method contributes to the protection of land owner’s right and reduces additional land flows in surrounding area while it requires longer development time and does not ensure qualified development. On the other hand, public land development by compulsory purchase helps provide promptly enough land but increase in land prise in the surrounding area, caused aquisition and development. The government has proposed a plan to adopt a new approach, as bond compensation and substitute land compensation, through revision of “the act on acquisition and compensation of land for public utilities” to public land development which would reduce land price instability in surrounding area of public land development arising from cash oriented land compensation system. The main theme of this study is two fold. One is evaluate as to whether substitute land compensation is Constitutional “fair(justified) compensation”. Another is suggest improvement of substitute land compensation system for stabilizing land policy.
