청약철회권의 행사기간 및 기산일에 관한 연구

특수 소비자계약에 있어서 소비자보호방안 중 핵심은 청약철회권이다. 물론 이의 발생요건을 비롯하여 배제사유와 이의 효과는 매우 중요한 문제이다. 그러나 이와 더불어 중요시되는 문제가 바로 청약철회권의 행사기간 및 기산일이다. 그러나 현행 소비자보호법상 청약철회권의 행사기간과 이의 기산일은 청약철회권의 본질적 취지와 일치하지 않기 때문에 다음과 같은 개정이 필요하다. 첫째, 행사기간은 개별적이 아닌 통일적으로 규정할 필요가 있다. 둘째, 사업자가 청약철회권 및 주소에 관한 정보를 제공하지 않은 경우에 있어서 이의 기산일은 소비자의 인식가능성이 아닌 사업자가 청약철회권 등에 관한 정보를 제공한 시점으로 정하여야 할 것이다. 셋째, 청약철회권의 행사기간의 장기화로 인하여 발생할 수 있는 문제를 해소하기 위하여 최장기간을 설정하여야 할 것이다. 넷째, 행사기간의 기산일은 급부의 목적물에 관계없이 통일적으로 규정하기 보다는 급부의 목적물의 특성에 따라 달리 정하여야 할 것이다. 다섯째, 제3자를 위한 소비자계약에 있어서 기산일은 소비자가 아닌 제3자를 기준으로 하여야 할 것이다. 여섯째, 행사기간의 단위는 역일이 아닌 영업일로 개정하여야 할 것이다. 마지막으로 사업자의 방해행위가 존재하는 경우에 있어서 기산일에 대한 불명확성을 해소하기 위하여 이의 기산일을 객관화할 필요가 있다.
Abstract
It is a right of withdrawal that is a core method to protect consumer in special consumer contracts. Of course, exercise conditions, exceptions and effects of right of withdrawal are very important. But period and initial date of right of withdrawal are also important. Nonetheless, provisons of consumer protection acts as to the period and initial date of right of withdrawal must be revised as following because these provisions didn't accord with the purpose of right of withdrawal. (1) A withdrawal period must be unified. (2) If a business didn't provided informations(his/her address and right of withdrawal), the withdrawal period should be started at the time which a business provides these informations. (3) It is needed to be provided the long stop maximum time. (4) The initial date of right of withdrawal will be provided differently, depending on the nature of the subject matter. (5) It will be based on a third party rather than the consumer in determining the initial date of right of withdrawal. (6) In the unit of exercise period, calendar days should be revised to business days.
