성적지향과 성별정체성에 관한 국제인권법 동향과 그 국내적 적용

초록

이 논문에서는 시민권규약과 사회권규약 등 주요 인권규약에서 성적지향 또는 성별 정체성을 차별금지사유의 하나로 인정하고 있는 최근 국제법 동향을 검토하고, 이러한 국제인권규범이 가지는 국내적 의미와 그 적용방안에 대하여 논한다. 우리나라는 위 규약 당사국으로서 국내이행에 관한 국제법적 의무를 가지는 것 외에도, 헌법상 국제법 존중주의와, 시민권규약과 사회권규약에 관하여 헌법적 효력을인정한 판례들을 고려할 때, 성적지향과 성별정체성에 관한 국제인권법 법리가 국내에서 헌법적 가치를 가지고 적용될 수 있다고 본다. 또 국내법적으로 이러한 법리의 직접적 효력을 인정하지 않더라도 우리 헌법상의 인격권 및 행복추구권, 사생활의 자유, 평등권을 해석하고 적용할 때 국제인권규범과 정합성을 이루어야 할 필요가 상당하다. 만일 이러한 국제법상의 규범을 부인하고자 한다면 정당한 국가상황이 있어야 하는데, 지금까지 성적 소수자에 대한 차등적 대우를 정당화하기 위하여 제시된 논거들은 편견을 기초로 하고 있어 합리적인 근거가 될 수 없으며, 오히려 혐오선동과 차별조장을 차별의 한 형태로 보고 이에 대응하는 국가적 조치가 필요하다고 논한다.

Abstract

In recent legislative activities on human rights and nondiscrimination in South Korea, the issue of lesbian, gay, bisexual, transgender, and intersex (LGBTI) people has become controversial. In some occasions, the Korean government sided with anti-LGBTI groups, and recently the Minister of Education even made an official remark that effectively denied the nondiscrimination principle as for LGBTI people. Against this background, this article overviews the international jurisprudence that has been developed to recognize the nondiscrimination principle as to sexual orientation and gender identity under, among others, the International Covenant on Civil and Political Rights (ICCPR) and International Covenant on Economic, Social and Cultural Rights (ICESCR), and argues that the state obligations under the international law should be domestically recognized and applied. As a party to the international human rights treaties, Korea has the obligation for domestic implementation. Moreover, the Korean Constitution mandates domestic application of international law under the principle of respect for international law. In particular, the rights stipulated in ICCPR and ICESCR have been recognized to have constitutional values in several constitutional court cases. It then follows that the international jurisprudence on nondiscrimination applied to sexual orientation and gender identity may have binding effect that bears an authority equivalent to the Constitution. Even if its direct binding effect may be denied for the reason that sexual orientation and gender identity is not explicitly enumerated in international human rights treaties, the constitutional demand under the principle of respect for international law that domestic laws be consistent with international law may guide that relevant articles in the Korean Constitution, including the right to personality and pursuit of happiness, freedom of private life, and the right to equality before law, be interpreted and applied in line with the international jurisprudence. The non-discrimination principle under the international law may be set aside if there is legitimate state interest to justify differential treatment against LGBTI people in Korea. However, the reasons proffered and discussed in Korea are mostly mere expression of prejudice and homophobia that contain no truth. In fact, this indicates that the Korean government should recognize that an action intending to promote hatred against LGBTI people is actually a form of discrimination that may require governmental responses.
