지적공부와 부동산등기부의 법적 효력과 관할기관에 대한 고찰

초록
장래에 어떠한 문제가 발생할 것인지를 현재의 시점에서 정확하게 예측할 수는 없지만, 그것이 사회질서를 규율하는 법 제도라고 한다면 불합리한 결과가 발생되지 않도록 그 위험성을 최소화할 수 있는 방법이 다양한 시각에서 모색되어야 한다. 지적제도의 경우에는 근대이후에 새롭게 창출된 제도라는 점에서 종래의 문제점들을 면밀하게 파악한다면, 장래에는 보다 합리적이고 실질적인 정의에 합치되는 지적제도를 마련할 수 있을 것으로 보여 진다. 그런데 근대적인 부동산제도가 창설된 이후에 부동산의 권리관계와 관련하여 효율적인 관리가 되어 왔지만, 당해 토지 및 그 정착물 등의 부동산의 권리공시제도, 관련 공부 및 관할기관이 각각 분리되어 운용됨으로 인하여 부동산 공부의 공신력은 저하되고 있는 실정이다. 특히 각 부동산 공부사이에 등기 및 등록사항이 불일치되는 현상으로 인하여 각종 부동산 공부를 확인하고 발급하는 과정에서 상당한 시간적, 경제적 비용이 소요되고 있는 실정이다. 이러한 이유로 본고는 각종 지적공부와 부동산등기부의 법적 효력을 검토하고, 양 공부의 관할기관을 통합하는 방안에 대하여 검토하였다.
Abstract
It would be difficult at the present moment to predict exactly what problems may arise in the future. However, there should be efforts to find solutions for problems related to regulation of public order so that the risk of causing unreasonable consequences can be minimized. Since Cadastral System is something that is being newly developed, a thorough examination of past problems can lead to a future cadastral system that is more rational and accords with substantial justice. As modern real estate system established, official notice system of real estate and related real estate register and diversified organization lead to deterioration in public confidence regarding real estate register. Also, These things created problems such as discordance of recordings and economical cost for confirmation and issuance of real estate register. Therefore, he purpose of this study is to examine the way to integrate governing body and legal effect of cadastral register and real estate register.
