특허권리성에 영향을 미치는 요인에 대한 연구: IT관련 한국특허의 내용분석을 중심으로

최근 들어 선진국을 중심으로 노동, 자본에 근거한 유형자산을 통한 경제성장에서 정보, 지식에 근거한 무형자산으로 경제성장동력이 전환되고 있다. 다양한 형태로 존재하는 무형자산 중 특허는 경제적 가치를 지닌 대표적인 무형자산으로, 특허의 질적 수준에 대한 분석은 연구개발 활동의 질적 수준과 연계된다. 일반적으로 특허는 시장성, 실용성, 권리성 등을 통해 질적 우수성을 가늠할 수 있는데, 특히 질적 우수성 측정항목 중 특허권리성은 특허문서의 내용분석을 통해 파악이 가능한 특허의 법적 보호범위 및 보호강도를 설명하는 중요한 요소이다. 그러나 이러한 특허의 권리적 우수성에 영향을 주는 요인들을 파악하는 연구는 아직 미흡한 실정이다. 따라서 본 연구에서는 텍스트 마이닝과 다중선형회귀분석을 활용하여 IT관련 특허의 내용분석을 통해 권리적 우수성에 영향을 미치는 특허의 요인들을 추출하고, 각 요인들의 영향을 실증분석한다. 본 연구의 분석결과 및 방법은 특허의 권리적 우수성을 확보하기 위한 가이드라인이자, 향후 권리적 우수성을 계량적으로 측정하기 위한 방법론 개발의 기초연구가 될 것으로 기대된다.
Abstract
Today, the gravity of economic growth is moving from tangible assets such as labor and capital to intangible assets including information and knowledge. Among various intangible assets, patents are the representative assets that are developed to make economic value, so the qualitative excellence of patents is considered to be significant. Specifically, the quality of patent right that includes the legal scope and the legal solidity of patent right is a crucial factor to identify patent value together with marketability and utility. However, little attention has been paid to identify factors influencing the quality of patent right and to analyze their effects. Because legal scope and solidity of patent right are described in patent text, this paper identifies and analyzes the factors influencing on the quality of patent right by exploiting textual analysis of IT-related patents and multiple linear regression analysis. We believe that the results and the method of this research can be not a guideline for quality patents but also a basis for quantified evaluation of the quality of patent right.
