게임물의 사행화 규제 및 그 타당성 검토

초록
최모든 사행성은 규제되어야 하는가? 어느 정도의 사행성은 인간의 본성이기 때문에 내기라는 방식에는 존재한다고 한다. 이러한 본성을 본질적인 억제가 아닌, 어느정도의 관리를 통해서 확산되는 것을 막는 것이 필요하다고 하겠다. 따라서 모든 사행성의 규제가 아닌, 그 규제의 정도와 방법의 합리성을 담보할 수 있느냐 하는 점에대한 고민이 필요하다고 본다. 게임법은 사행성게임물에 대한 규제 규정을 담고있지만, 사행성에 대한 개념이나규제 기준을 두고있지 않다. 물론 사행성이라는 것이 인간의 습성이기 때문에 일률적으로 체계화하는 것은 불가능할지도 모른다. 그럼에도 불구하고, 사행성에 대한 판단을 통해서 사업자를 규제하는 현행 법체계 하에서는 사행성에 대한 명확한 기준설정이 필요하다고 본다. 문화부나 게임물등급위원회의 규제정책은 헌법상의 기본권을 제한하거나 또는 법적 근거를 두지 않고 있다. 규제는 정치한 논의나 계획을 통해 수립되어 집행되지 않을 경우, 사업자에 대한 법적 안정성을 담보해주지 못한다. 따라서 규제는 정당성 및실효성과 아울러 사업자의 예측가능성을 확보할 수 있어야 할 것이다.
Abstract

Nevertheless, under the current legal framework, through judgments about gambling operators to regulate gambling on setting clear standards for it would be necessary. MCST and the Game Rating Board’s regulatory policies or the basic constitutional right to limit is not a legal basis. If you do not enforce regulations are established through political discussions or plans to ensure legal stability. Thus, the legitimacy and effectiveness, as well as regulatory predictability operators be able to acquire.
