헌법에 대한 정치학적 접근: 정치교육과 법교육의 교차지점인 헌법교육을 위한 하나의 시론
A Political Approach to Constitution: An Essay for the further Development of Constitution Education as an Intersectional Area between Political Education and Law Education

고등학교 사회과 선택과목으로 분리되어 있던 ‘정치’와 ‘법과 사회’ 교과서가 통합되면서, ‘법과 사회’ 교과서의 헌법 챕터는 정치교육과 법교육의 교차지점이 되었다. 그 결과 헌법교육의 중요성에 대한 공감대는 정치교육과 법교육에서 공히 강화되어 왔으며, 이러한 맥락에서 헌법에 대한 정치학적 접근과 설명은 학문적이고 교육적인 측면에서 아주 강하게 요구되어 왔다. 헌법은 ‘법 중의 법’ 이거나 ‘최고법’이라는 법적인 접근과 설명만으로는 제대로 이해하기 어렵다. 헌법에 대한 총체적이고 실체적인 이해는 정치적인 접근이 법적 접근과 조화를 이루거나 아니면 일정 정도 우위를 점해야만 가능하다는 것이 필자들의 생각이다. 이 글의 목적은 헌법에 대한 정치적인 설명을 정리하고 정교화함으로써 정치교육과 법교육의 일종의 가교를 건설하는 것이다. 이러한 목적을 수행하기 위해 이 글은 먼저 헌법의 정치적인 성격을 집중적으로 살펴보고, 그 다음 챕터들에서 각각 87년 헌법 체제의 문제점과 헌법 개정을 둘러 싼 논쟁 및 방안 등을 검토한다.
Abstract
As the two separated former textbook of 'Politics' and 'Law and Society' have been integrated as a single textbook of 'Law and Politics' in the high school two years ago, in the newly integrated single textbook of 'Law and Politics', the chapter explaining Constitution has become an intersectional area between Politics and Law. And as a result, the importance of Constitution education in the textbook of 'Law and Politics' has been constantly strengthened. In this context, there has been a strong academic and educational demand for the political approach toward constitution. The main purpose of this article is to build a bridge connecting political education and law education by elaborating political explanations toward constitution. In order to fulfill this purpose, this article reviews several topics related to constitution education which is viewed from politics. This article starts from the review of political characteristics of constitution, and then this article goes further to examine the special features and problems of 'the Year 1987 Constitution' and the debates and methods of constitutional re-design in the following chapters.
