다문화주의의 헌법적 수용에 관한 연구

초록
급속히 다문화사회로 변화해 가는 한국사회는 다문화주의적 입장 정립과 그에 기초한 다문화사회의 문제를 해결하여야 하는 과제를 앉고 있다. 다문화 사회로의 변화원인은 우리나라 내부의 구조의 변화에 기인한다. 저출산․노령화에 따른 인구구조의 변화와 경제구조의 변화가 가져온 노동시장에서의 노동력 부족, 농촌사회의 급속한 변화, 경제발전 등은 주변국에게 노동력 제공, 결혼이주, 경제적 이유에 의한 체류의 유입요인을 제공하였고 그 결과 많은 외국인이 한국에 유입된 것이 그 원인이다. 한국사회는 물론, 헌법을 비롯한 법체계는 이러한 변화에 적응하기 못하고 있어서 여전히 기존의 인식과 그에 기초한 이론과 정책으로 대응하는 관계로 다문화사회의 본질적인 문제는 해결하지 못한 채 어려움에 빠져 있다. 새로운 패러다임에 대응하는 다문화주의적 인식과 이러한 인식을 기초로 하는 법체계의 구축이 필요하다. 이미 다문화사회를 경험하고 이에 대한 다문화주의를 구체화한 외국의 사례가 시사점이 될 것이다. 그러나 무엇보다도 외국인과 그들이 가져온 문화에 대한 이해가 선행이 되어야 한다. 단일문화, 단일 민족에 익숙한 한국사회가 전통적․민족적 정체성을 고수한 채 우리 사회에 유입된 외국인과 그들의 문화를 바라보고 대응하려 한다면 깊은 갈등과 긴장을 내포한 동화주의적 다문화주의만이 남을 것이다. 타자와 내가 동일한 공간에서 고유의 정체성을 유지하면서도 타자를 이해하고 인정하며, 타자와 나 사이의 차이를 승인하고 공존하기 위한 다문화주의가 모색되어야 한다. 차이의 인정과 타자에 대한 승인을 위한 제도적 장치와 이를 근거지우기 위한 헌법정책적 대응을 위한 기초로서 다문화주의에 대한 깊은 성찰이 있어야 한다.
Abstract
Korean society will change to a multicultural society rapidly. Korea is faced with the tasks to be settled and the consequent problems of a multicultural society multiculturalism. Cause of the change in the multicultural society is due to changes in the internal structure of Korea. Labor shortages in the labor market changes in the economic structure and demographic changes associated with the aging population has brought rapid changes of rural society, and economic development to provide labor to neighboring countries, immigration marriage, economy providing a flow factor of stay by reasons, and as a result, that is the cause that many foreigners flowed into Korea. Korean society, including the legal system, the Constitution, not been able to adapt to these changes. Corresponding theory and policy based on the recognition of existing and hence are having difficulty to solve the inherent problems of a multicultural society. Multicultural recognition and to respond to the new paradigm based on the perception that the legal system is necessary to build up. The case of a foreign experience for multiculturalism and multicultural society materialize, the implications will be. However, there must be a prior understanding of foreign cultures and they brought more than anything. Korean society accustomed to single culture and traditional single race. Unilateral assimilative multiculturalism should be discarded in order to create a multicultural society, coexistence. If you only adhere to the existing recognition and response, deep conflicts and tensions within our society will be planted. Constitutional policy for the peaceful coexistence must be seek as soon as possible. While still maintaining a unique identity in the same space with me with others, understand others have acknowledged, multiculturalism in order to co-exist to recognize the difference between the others. And institutional apparatus for the approval of others and the recognition of difference, there is a need for profound reflection against multiculturalism as the basis for policy responses of constitutional basis for this.
