한국의 ICT 거버넌스 재설계 방안에 관한 시론적 연구 ― 단일행정부 이론과 독립규제위원회 이론을 중심으로 ―

초록
최근 한국에서 새정부의 출범과 함께 정부조직 개편이 뜨거운 쟁점으로 부각되고 있다. 특히 그동안 독립규제위원회의 형태를 띠고 방송통신 행정권을 행사해 온 방송통신위원회의 경우 ICT 산업진흥을 위하여 독임제 부처로의 변화가 논의되고 있음과 동시에 방송규제 업무의 위원회 형태 존속이라는 공감대가 형성되고 있다. 이와 관련 미국법상 단일행정부 이론과 독립규제위원회의 관계에 대해 살펴보는 것은 중요한 시사점을 준다. 단일 행정부 이론((Unitary Executive Theory)이라고 함은 미국에서 모든 행정권이 대통령에 속한다는 헌법 조항에 따라 대통령이 최고의 지위에서 행정기관의 의사결정을 통제할 수 있어야 한다는 이론이다. 독립규제위원회는 미국 헌법상 필요하고도 적절한 조항에 근거하여 특정한 경제, 사회문제에 대처하기 위하여 의회에 의하여 특별법에 의하여 설립되며 준입법권, 준사법권 외에도 처분 등 행정권을 행사하지만 어느 부에도 속하지 않는 기관이다. 이는 권력분립원칙은 물론 단일행정부 이론과 배치되는데, 이와 관련 합헌성 논쟁이 계속되고 있다. 한국의 경우도 행정권은 대통령을 수반으로 하는 정부에 속하는 등 단일 행정부 이론이 적용된다고 할 수 있다. 반면 독립규제위원회는 헌법상 직접적 근거 없이 정부조직법상 소관사무의 일부를 독립하여 수행할 필요가 있는 경우 법률로 정하는 바에 따라 둘 수 있게 되어 있을 뿐이다. 대통령의 행정각부를 통한 행정권 수행의 원칙 등에 비추어 독립규제위원회가 행정권을 행사하는 것은 한국 헌법의 질서와는 이질적인 것으로 볼 수 있으며, 더욱이 대통령으로부터 전적으로 독립된 행정권을 행사하는 경우에는 더욱 강한 위헌에의 의심이 있다고 할 수 있다차기정부의 조직 특히 ICT 거버넌스의 재설계에 있어서 쟁점은 독임제 부처 설립여부와 독임제 부처 설립시 방송규제 관련 위원회와의 관계 설정인바 이에 대해서는 각각 反應性의 원칙과 合憲性ㆍ合法性의 원칙을 고려하여야 한다. 반응성의 원칙은 행정수요 및 환경의 변화에 부응하는 조직을 설계하여야 한다는 것으로, CPND라는 ICT 생태계 구축을 위하여 독임제 부처를 신설할 필요가 있다는 것이다. 합헌성ㆍ합법성의 원칙은 독임제 부처 신설에 따른 위원회 설계시에 헌법과 법률을 위반하지 않아야 한다는 것이다. 방송 규제 관련위원회는 행정권의 대통령에의 전속적 귀속 원칙, 행정 각부를 통한 행정권 행사 원칙 및 예외적인 합의제 위원회 구성 원칙 등을 고려하여 설계되어야 한다. 방송규제 관련 위원회에 방송사업자 인허가 등 종래의 전통적 행정권 행사에 해당하는 행정적 기능을 이관하거나 동 위원회의 지위를 대통령 소속으로부터 독립시키는 것은 적절하지 않다고 볼 수 있다. 결론적으로 지속적인 글로벌 경제위기, 첨단산업의 국제경쟁력 약화, 대중소기업간ㆍ세대간ㆍ지역간 격차의 확대, 청년실업문제의 심화 등 한국이 직면하고 있는 위기상황을 극복하기 위해 스마트한 정부의 역할이 요구되고 있다. 스마트 시대의 기업은 fast-follower가 아닌 first-mover가 되어야 하고 ICT 부처는 디지털 생태계 전반의 조정자ㆍ촉진자ㆍ후원자로서 환경조성과 공정한 경쟁규칙 정립에 주력하여야 할 것이다. 이 모든 과제를 달성하기 위한 첫번째 수단이 바로 스마트 시대에 적합한 ICT 거버넌스 설계라는 점을 인식할 필요가 있다.
Abstract
Along with the launching of the new administration in Korea, the reshuffling of the government organization has become a major issue. In particular, the Korea Communications Commission, which has exercised broadcasting and communications-related administrative powers in the form of an independent regulatory commission ,is being the subject for a change into single decision-making agency for the purpose of promoting the ICT industry. Simultaneously, a consensus is being established over the maintenance of the broadcasting regulatory work in the form of a commission. In connection with the foregoing, taking a look at the relationship between the unitary executive theory and independent regulatory commission gives an important implication. The unitary executive theory positions that the President at the top level should be able to control the decision-making of the executive branch in accordance with the clause of the U.S. Constitution providing that the executive power shall be vested in a President of the United States of America. Pursuant to the Necessary and Proper Clause of the U.S. Constitution, an independent regulatory commission is established based on a special law enacted by the Congress for the purpose of coping with specific economic and social issues. An independent regulatory commission exercises administrative powers, such as dispositions, in addition to quasi-legislative and quasi-judiciary powers, but does not belong to any of the any branches. This aspect goes against not only the principle of the separation of powers but also the unitary executive theory, and the constitutionality issue thereof is still under debate. The unitary executive theory can also be said to apply in Korea in that the executive powers belong to the government headed by the President. On the other hand, an independent regulatory commission is merely allowed to be established under the laws if it is necessary to carry out parts of the works concerned pursuant to Government Organization Act without direct constitutional grounds. In light of the principle of the President’s enforcing executive powers through each ministry under the constitution, the exercise of executive powers by an independent regulatory commission can be regarded as a disparate point from the Korean constitutional order. Further, the exercise of executive powers completely independent from the President can raise doubts for being even strongly unconstitutional. The issue concerning the organization for the next administration, in particular with the re-designing of the ICT governance, is (i) the question over the establishment of an single decision-making agency and (ii) the configuration of the relationship between the single decision-making agency and the broadcasting regulatory agency if the single decision-making agency is established. In this regard, it is essential to consider for each of the foregoing question the principles of reactivity, constitutionality, and legality. The reactivity principle suggests for an organization which meets the administrative needs and the changes in the environment, and thereby necessitates for the establishment of an single decision-making agency to construct the ICT ecosystem labeled as CPND. The constitutionality and legality principles provide that the designing of a relevant commission in accordance with the establishment of the single decision-making agency must not violate the constitution and the laws. A broadcasting regulatory commission must be designed by taking into account the following principles: (i) the executive powers exclusively belong to the President; (ii) the executive powers shall be exercised through each of the executive department; and (iii) formation of an exceptional representative agency. With this in mind, it is deemed improper to transfer administrative functions corresponding to conventional exercise of administrative powers, such as issuance of approval for broadcasting enterprisers, to the broadcasting regulatory commission or to make the foregoing commission independent from the President. In conclusion, a demand for the role by a “smart” government exists to overcome the following challenges we have been facing: the persistent global economic crisis; the undermining global competitiveness in the high-tech industry; increase in disparities between large companies and SMEs, between generations, and between regions; and the deepening of the youth employment issue. In such “smart” era, companies should become not a fast-follower but a first-mover, and the ICT agency should dedicate itself in establishing an atmosphere whereby it acts as the mediator, facilitator, and promoter for the entire digital ecosystem as well consolidating fair competition rules. Thus, it is necessary to conceptualize the design of an ICT governance well-suited for the “smart era” as the initial step to achieve all of the foregoing tasks.
