지방의회제도의 문제점과 발전방안

초록
지방의회는 헌법에 의하여 설치되는 주민대표기관으로서 지역에 있어서 정책적․입법적․의결적 기능 등을 수행하는 지방자치단체의 핵심기관이다. 그런데 오늘날 지방의회의 지위와 권한은 상대적으로 약화되어 있고 그 역할도 만족할 만하지 못하다. 본 연구에서는 위와 같은 문제의식을 바탕으로 현행 지방의회제도를 전반적으로 진단하면서 문제가 되는 영역이나 사항들을 추출해내어 이러한 문제들을 법제도적으로 개선하기 위한 방안을 강구하는 데 초점을 맞추었다. 주민대표기관인 지방의회의 위상과 기능의 강화는, 근본적으로 지방자치의 취지에 부합하는 것이고, 현실적으로도 지방분권의 확대, 주민의식의 향상 등의 변화에 따라 시의적으로도 매우 강하게 요청되고 있다. 본 논문에서는 이를 위하여, ⅰ) 지방의회의 권한을 다양한 차원에서 확대함과 동시에 ⅱ) 지방의회별로 그 규모나 특성 등을 감안, 조직의 다양화 및 운영의 자율화를 기할 수 있는 방안을 모색하고, 나아가 지방의회 내지 의원에게 요구되는 전문성을 확보하기 위하여 크게, ⅰ) 조직적인 측면에서의 지방의회의 구조적 전문성 제고방안과 ⅱ) 지방의회의 구성원인 의원 및 보좌진 등의 인적․기능적 전문성 향상방안 등을 검토하였다. 그리고 보충적으로 지방의원의 의정활동을 지원할 수 있는 방안도 살펴보았다. 이와 같은 견지에서, 과거 지방의회의 존재를 그다지 중시하지 않던 상황에서 규정되었던 다양한 국가법의 지방의회 통제장치들을 지방의 시대에 부합하는 방향으로 하나둘 제거 내지 완화하여 새 시대에 부합하는 지방의회의 상을 만들어 감으로써 궁극적으로 지방자치의 안정적 발전에 기여하고자 하였다.
Abstract
The local assembly of local government is a representative agency of local citizens based on constitutional law. The local assembly is the essential agency which usually plays the role of policy-making, local legislation, main decision-making in local government. These days, however, the powers of local assembly are not strong comparative to the governor of local government in Korea and we can't be satisfied with the functions of local assembly. This thesis are focused on the problems and the legal development schemes of local assembly. The strengthening of powers and functions of local assembly as a representative agency of local citizens fundamentally coincides with the local autonomy. I would like to propose the following 3 schemes for the development of local assembly system. First, the powers of local assembly should be strengthen rather than now in many ways. Second, the local assembly should be more specialized in the aspects of organization structure. Third, the members of local assembly and local government employees(civil servants) should be more specialized through the good education and exercise systems.
