DVD 지역코드 우회기술의 기술적 보호조치의 면책범위 포함에 관한 연구 - 룰메이킹 절차에 의한 해결을 중심으로 -

지역코드는 ‘DVD에 있는 지역코드 플랙’과 ‘DVD 플레이어에 의한 지역코드 체크’라는 두 가지 요소로 구성된 것으로서, 지역코드 시스템의 기본 원리는 DVD 지역코드 플랙을 적용하여 DVD 플레이어로 하여금 지역코드를 체크하게 함으로써DVD와 플레이어의 지역이 일치하지 않으면 DVD 콘텐츠가 재생되지 않는 것이다. 결국 DVD 지역코드는 접근통제를 위한 기술적 보호조치라 할 수 있다. 그런데 이 지역코드에 의하여 DVD를 정당하게 구입한 소비자도 DVD의 콘텐츠를 이용할수 없는 불합리한 경우가 발생하였고, 이러한 문제의 해결방법으로 “코드프리”라는 우회조치가 이용되었다. 그런데 이에 대하여 기존의 이용통제 기술적 보호조치만이 입법되어 있던 개정전 저작권법 하에서는 저작권자에게 많은 배타적 권리를부여하면서도 한편으로는 이용자(소비자)의 공정이용을 보장하여 저작권의 균형이 유지되도록 하고 있었기 때문에 코드프리 행위는 일반적으로 허용되는 것으로 인식되었다. 그러나 한·EU FTA에 의하여 저작권법에 새로이 도입된 접근통제 기술적 보호조치는 그동안 저작권 보호방식과는 달리 저작물 이용에 대하여 저작권자에게 저작물에의 접근 자체를 통제할 수 있는 권한을 부여하는 제도로써, 기존의 저작권보호 법제와는 다른 기반에 근거하여 일반 이용자(소비자)의 기본권이라 볼 수 있는 접근권 및 문화향유권 등과의 충돌을 야기함과 동시에 심대한 제약을 끼치게 되었다. 따라서 본 논문은 “DVD 지역코드”의 우회라는 “코드프리”가 기술적 보호조치 우회금지의 면제에 포함될 수 있는지를 미국의 2000년과 2003년의 룰메이킹 과정에서의 저작권청 권고안을 검토함으로써 살펴보았다. 그리고 그 검토결과, 2003년이후에 이루어진 디지털과 인터넷의 급속한 발전, 그리고 아날로그 영상저작물 저장 매체의 쇠퇴라는 시대의 흐름을 반영하여, DVD 지역코드의 우회 조치인 ‘코드프리’는 공정이용에 해당하여 저작물의 비침해적 이용이며, 그동안 DVD 지역코드는 저작물의 이용에 있어서 심각하고 중대한 부정적 영향을 끼쳤다고 분석하고, 다음과 같은 결론을 도출하였다. 코드프리된 DVD 플레이어의 사용은 적법한 이용이며, 따라서 이러한 기기의 제작자 및 배포자 등도 호환성을 위한 경우에 해당되어 기술조치 우회도구의 거래금지 규정을 위반하지 않는 결과가 된다. 그러므로 코드프리는 우회금지에 대한예외가 되어야 하며, 향후 3년 뒤 고시를 개정할 때에는 DVD 코드프리가 기술조치 우회금지에 대한 예외의 경우에 당연히 포함되어야 할 것으로 판단한다.
Abstract
Various technological access control measures increasingly protect motion pictures in DVD format. One such technology is the region code system, which purportedly was designed to prevent a DVD manufactured for sale in one region of the world from playing on a machine not manufactured for sale in that same region. As a result, consumers might not be able to play DVDs purchased in one region on a device manufactured in another region, permitting movie studios to control the availability of motion picture DVDs in different regions of the world. Therefore some users have used any circumventing activity or any device enabling circumvention of the region coding system such as multi-zone DVD players using “Code Free”. In Korean Copyright law, this matter has not been an important or attractive academic subject matter and the use of any activities or devices enabling circumvention of the region coding system has been regarded as fair use or exemptions of anti-circumvention in existing Copyright Law. The amendment of Copyright Law for implementing pledges agreed that the Korea-the European Union Free Trade Agreement (Korea-EU FTA) bars any devices or means that circumvent access-control technologies, however there have been few studies in this area. So, this article first provides background information related to the DVD region coding system including the anti-circumvention provisions of Korean Copyright Law, and then analyzes the Recommendation of the Register of Copyrights of both 2000 and 2003 dealing with rulemaking on exemptions for prohibition of circumventing the Copyright Protection Systems for Access Control Technologies. In conclusion, this paper argues that because multi-zone DVD players do not facilitate infringing use, prohibiting such devices impairs the public’s right to use legitimately acquired property and suggests that non-infringing circumvention of region coding by lawful owners of DVDs should be included in the exemptions to the prohibition on circumvention.
