소송에서 계량경제학 기법의 활용

이미 미국과 유럽에서는 소송, 정부규제 및 정책집행 등의 분야에서 광범위하게 활용되고 있는 경제분석이 한국에서 올바로 자리잡는 데 조금이나마 도움이 되었으면 하는 것이본고의집필동기이다. 특히소송에서계량경제분석이어떤식으로활용될수있는지를구체적인 실례를 통해 소개함으로써 법원의 이해를 제고시키고, 경제분석 전문가로 활동하는데있어서 도움이 되는 내용들을 살펴본다. 계량경제학의 여러 이론 및 모형 가운데 가장 기본적이며, 여러 분야에서 광범위하게 사용되고 있는 회귀분석(regression analysis)의 실제 적용부분에 초점을 맞추어 회귀분석 방법을 실제 소송 케이스 혹은 응용 법경제학 분야에 어떻게적용할수있는지, 활용함에있어서혹은분석결과를해석함에있어서유의해야할점들은 무엇인지에 관해 살펴본다. 본 논문은 판사, 변호사 등 경제학 background가 없는 법조인들을 대상으로 하기 때문에 주요한 계량경제학적 이슈들에 대한 이론적·기술적인 설명보다는 그러한 이슈들이 발생한 구체적인 사례들을 가급적 이해하기 쉬운 용어로 해설함으로써실무적도움을제공하는데초점을맞추고있다. 보다깊이있고체계적인이해를원한다면, 참고문헌에기술되어있는기본적인계량경제학텍스트들이도움이될것이다.
Abstract
This article purports to get judges and lawyers who do not have backgrounds in economics familiar with use of econometrics in their case decisions and/or practices. Econometrics have been widely employed in litigations, government regulations, public policies, etc. in the United States and Europe. By presenting actual cases and examples rather than discussing theoretical/technical issues, this article helps judges and lawyers more comfortably get the sense of how econometrics are used, what factors are important in applying econometrics, and what results should be paid attention to in interpreting empirical findings. At the end of reading this article, hopefully the informational gap between economists/econometricians and judges/lawyers will be narrowed. Anyone who are interested in more details and technical issues can refer to econometrics textbooks listed in the Bibliography.
