한・일 정보보호협정의 체결형태에 관한 논란과 개선과제

우리나라는 다른 나라들, 주로 미국과 많은 안보 협정을 체결하였다. 그 협정들은 당사국에게 부과하는 의무의 중대성과 대상 면에서 매우 다양하다. 어떠한 군사ㆍ안보 협정은 상호원조 또는 안전보장에 관한 조약, 국가나 국민에게 중대한 재정적 부담을 지우는 조약, 또는 입법사항에 관한 조약에 해당하여 그 조약의 체결ㆍ비준에 대하여 국회의 동의를 받았다. 한편 여타의 군사ㆍ안보 협정은 국회의 동의 없이 대통령이 스스로 체결하는 조약, 외교통상부 장관이 체결하는 고시류조약, 국방부 장관이 체결하는 기관간 약정의 형태로 체결되었다. (군사)정보보호약정은 지금까지 국회의 동의 없이 체결하는 조약 또는 기관간 약정의 형태로 체결되었다. 2012년 6~7월 「대한민국 정부와 일본국 정부 간의 비밀정보의 보호에 관한 협정」(이하, 한ㆍ일 정보보호협정)의 체결을 둘러싼 논란이 가열되었다. 충분한 여론 수렴 및 국회와의 협의를 거치지 않은 채 정부가 협정안을 국무회의에서 비공개로 의결하였기 때문이다. 이에 대해 국내에서는 국회의 동의를 받아야 한다거나, 국회에서 논의한 뒤에 처리해야 한다고 거센 반발이 있었고, 결국 6월 29일 협정 체결 직전에 우리 측의 요청으로 체결이 연기되었다. 이를 계기로 하여 다른 나라와 체결한 군사정보보호협정은 물론 지금까지 우리나라가 체결한 모든 군사조약의 체결과정을 객관적으로 검토해야 할 필요성이 대두되었다. 그래서 이 글에서는 먼저 논의의 발단이 되는 한ㆍ일 정보보호협정을 개관하고, 군사ㆍ안보조약의 체결과 관련한 우리나라와 다른 국가들의 관행을 살펴본 후, 국회의 대응방안에 대하여 생각해 보고자 한다.
Abstract
The Republic of Korea is a party to numerous security agreements with other nations, primarily the United States. The topics covered, along with the significance of the obligations imposed upon agreement parties, may vary. Some international security agreements entered by the Republic of Korea, such as those obliging parties to come to the defense of another in the event of an attack, those imposing substantial financial burden, or those having legislative effect, meet the constitutional requirements and have been entered as treaties, ratified with the consent of the Legislature. Other agreements dealing with more technical matters, such as the protection of classified military information, are entered more routinely and usually take a form other than a treaty, ratified with the consent of the Legislature (i.e., as a treaty, ratified without the consent of the Legislature or an agency-to-agency arrangement). Occasionally, the substance and form of a proposed security agreement may become a source of dispute between the Legislature and the executive branch. In 2012, the executive branch negotiated and was about to sign an Agreement on the Protection of Classified Information with Japan in furtherance of efforts to ensure the reciprocal protection of classified military information exchanged between the Parties. The negotiations revealed a lack of domestic consensus regarding the prerogatives of the Legislature and the President with respect to this type of treaty – whether the constitutional requirements for the legislative consent to the President entering into the treaty was met and whether prior consultation with the Legislature in a transparent manner was needed– even though the Republic of Korea previously had entered into many General Security of Military Information Agreements (GSOMIAs) with 23 countries and one international organization. For months, a high profile debate about separation of powers played itself in the context of three pieces of legislation proposed by Members that would increase the Legislature’s role in concluding a treaty, and on the editorial page of newspapers. In this debate, the central separation-of-powers issue in the treaty formation context was not definitely resolved. It is likely that future disputes will arise between the political branches regarding the entering of international security agreements. Regardless of the form a security arrangement may take, the Legislature has several tools to exercise oversight regarding the negotiation, form, and conclusion of the agreement by the Republic of Korea. This paper begins by providing context concerning the negotiation and the text of the Agreement on the Protection of Classified Information with Japan. Next, the paper discusses historical precedents as to the types of international security agreements, with detailed attention paid to past security agreements entered by other countries. The paper discusses the oversight role that the Legislature exercises with respect to entering international security agreements involving the Republic of Korea.
