청소년 보호법상 매체 정책에 관한 비판적 고찰

South Korea has Juvenile Protection Act in order to help juveniles grow into the persons of sound character. According to Juvenile Protection Act, Korea government has the responsibility to regulate the distribution of harmful media materials among juveniles and their access to harmful entertainment establishments, and protect and rescue them from the injurious environment including harmful acts such as the abuse of and violence against them. On the other hand, Juvenile has the constitutional rights and parents have the right in children's nurturing and education. Meanwhile, Constitutional Court of Korea said "Parents' right in children's nurturing and education are to be respected in all areas of education. And, outside school area, parents' right of education take precedence over the State's. Nevertheless the Juvenile Protection Committee as national service makes a decision on its own regulation of distribution of media materials harmful to juveniles and then only wields. Furthermore, any online game service providers must not provide for juvenile to play online game from 0 A.M. to 6 A.M.. for juvenile protection. The policy for Juvenile Protection is starting to have painful costs. This article raises an objection in juvenile protection policy that parents' right was not considered and duly weighed. And tries to find a solution to an unconstitutional problem of Juvenile Protection Act.
