변호사 배상책임보험에 관한 소고

초록
최근 우리나라 법률시장에서는 변호과오소송이 증가하고 있으며 그 배상액도 고액화 되어 가고 있다. 이는 사회가 복잡다단해지면서 전문가라 할지라도 필요한 전문지식을 완벽하게 갖출 수는 없는 반면 의뢰인은 전문가에게 점점 더 높은 수준의 전문지식과 주의의무를 요구하는 것에 기인하는 현상이다. 또한 법학전문대학원의 도입에 따른 변호사 수의 증가로 변호사간의 연대의식이 약화되면서 변호과오소송은 가파르게 증가할 것으로 예상된다. 반면 변호사 수의 증가로 인한 소득구조의 양극화로 과거와 달리 변호사의 경제적 자력도 예전에 비하여 취약해질 것으로 생각된다. 이때 보험이 적용되지 않는 변호사는 개인이 손해배상책임을 지게 되어 그 재산을 위험에 노출시키게 되고 변호사의 재산만으로는 배상금을 지급할 수 없는 경우에 의뢰인이 고스란히 손해를 입게 된다. 법률시장에서 이와 같은 잠재적 위험은 점점 증가하고 있는데도 불구하고 우리나라에서의 변호사 배상책임보험에 대한 인지도는 매우 낮으며 그 필요성도 부각되지 않고 있고 우리나라 실정에 적합한 보험상품은 미개발된 상태이다. 본고에서는 전문가 위험의 개념과 변호사가 범할 수 있는 전문가 위험인 일반적인 변호과오의 유형 및 변호과오소송에 대하여 살펴보고 제외국의 변호사 배상책임보험의 운영사례를 검토한 뒤 우리나라의 변호사 배상책임보험의 구체적인 내용과 잠재적인 문제점, 개선점 등에 대하여 분석하여 추후 우리 실정에 맞는 전문가 보험상품 개발과 정책수립에 조금이나마 이바지하고자 한다.
Abstract
Recently, the number of legal malpractice lawsuit is increased in Korea, and the compensation for legal malpractice also become a large amount of money. This situation is caused by the complicated society which is difficult to understand even by the profession and the client who demand more high-qualified profession and higher duty to take care to the lawyer. Moreover the number of legal malpractice lawsuit will be increased rapidly because of the growth of the lawyer due to the law school and the weakening of conscience solidaire between lawyers. Contrarily, the rapid growth of the lawyer will cause the income polarization between lawyers and the financial of lawyers will be weakened. The lawyer without professional liability insurance will pay the expenses by his own property therefore he will take high risks, and if he can't compensate whole damages, the risk will be delegated to clients. The potential risk of legal market grows every year however the awareness for lawyers' liability insurance and its necessity is extremely low in Korea. Furthermore, there are no appropriate insurance for Korean lawyers without the insurance which provided by foreign insurance company. There has been no discussion for the lawyers' liability insurance before, I will review the general concept of legal malpractice and the legal malpractice lawsuit. After that I will discuss about the foreign lawyers' liability insurance and the specific Korean lawyers' liability insurance and its points of disputes. I hope this article will be contributed to the development of Korean lawyers' liability insurance and policy making for it.
