토지관련 공공기관 통합에 대한 공법적 검토 - LH공사를 중심으로 -

초록
헌법이 추구하는 이상적 헌법실현의 목표는 인간의 존엄이 유지되고 개인의 행복추구가 가능한 사회의 구현이다. 인간의 존엄과 행복추구를 위해서는 기본적인 욕구가 충족될 수 있는 조건이 마련되어야 할 것이며, 적어도 최소한의 조건은 국가라는 공동체에서 마련해야 한다. 협소한 국토와 급속한 도시화를 이룬 우리의 경우에는 토지정책과 주택정책의 공적기능이 강하므로 토지주택정책의 입안과 실천에 있어서 공공성이 중시되어야 한다. 현재 토지와 주택정책을 실천하는 공공기관으로는 한국토지주택공사(LH공사)가 대표적이다. LH공사는 기존의 한국토지공사와 대한주택공사를 현 정부에서 경영합리화를 이유로 통합한 것이다. 본 논문은 LH공사의 통합과 관련하여 우리 헌법에서 토지와 주택정책에 대한 헌법적 요청은 무엇이며, 국가의 책무, 그리고 이른바 공기업으로 분류되는 한국토지주택공사에 대한 공법적 요청은 무엇인지 살펴보고, 현 정부에서 LH공사로 통합되는 과정과 그 과정에서 제기 되었던 각종 문제점과 법학적 검토를 살펴보며, 통합이후에 LH공사에 대한 평가와 함께 차기 정부에서 토지주택관련 공기업 정책에 있어서 개선점을 도출해 보았다.
Abstract
President Lee administration has put forward integrating Korea Housing Corporation and Korea Land Corporation that have overlapping business areas related to housing supply as a top priority to achieve efficient public corporation reform. However, Living proper residential condition is one of fundamental rights granted in Constitution and there are government duties to make a national plan for housing and to supply proper housing standard and condition for maintaining the dignity of human. Because of President strong will, two pubic corporations had been integrated. It, however, is necessary to evaluate whether integration could lead enhanced not only efficiency but also humanity, Constitutionality, and duty of government. This article tried to figure out changed efficiency and legitimacy of integrated corporation by data and legal aspect and then tried to make suggestion of public housing and land policy for new coming administration.
