국내 자본시장법제의 개선방향 - 자본시장법 개정안에 대한 의견을 중심으로 -

After the global financial crisis of 2008, the regulation of financial market is a topic of hot debate in the world including Korea. In Korea, a lot of dispute cases involving risky and complex financial products ignited debates on how to reform the financial supervisory system. Many scholars also emphasized the importance of financial consumer protection. On the other, there also exists a request to expand the permissible scope of financial investment services. In response to these domestic and global market developments, Korean government proposed a bill to amend the Financial Investment Services and Capital Markets Act. This paper is to examine several legal and market issues covered in the Bill and to make some recommendation. The main issues include the definition of the term “financial investment products” which is key to fix the Act’s scope of application, the expansion of financial investment services and the regulation of investment management.
