도급과 파견근로계약의 노동법적 쟁점에 관한 소고

본고에서는 이러한 논리적 구조에 문제인식을가지고서 논의를 전개할 순서는, 먼저, 파견법이시행된 이후에 쟁점이 되었던, 사내하도급과 관련해 도급과 파견근로계약의 노동법적 쟁점에서대표적인 판례로 부각된「현대자동차(울산공장)사례』를 선정해 사건의 개요, 구제신청 및 그 경과, 법적 판단, 대상판결의 의미와 한계를 정리한다(Ⅱ). 이러한 현대자동차 사례에서 치열하게 다투었던 도급과 파견의 노동법적 쟁점이었던 묵시적 근로자계약관계의 성립 여부, 사내하도급이파견근로에 해당하는지 여부, 위법파견에 대한법적 효과(고용간주 규정의 적용, 고용의무 규정의 적용, 위법한 파견과 근로조건의 형성, 위법한근로자파견의 법적 효과에 대한 한국과 일본의차이 및 시사점 등)에 대해서 각각 구분해 검토한다(Ⅲ). 그리고 이러한 쟁점에 대한 비정규직고용법제의 정비방안으로 위의 도급과 파견근로계약관계의 노동법적 쟁점을 중심으로 파견법의개정안(은수미 안)에서 관련된 부분을 검토한다(Ⅳ). 마지막으로 결론에서는 위의 논의 결과를요약․정리한다(Ⅴ). 아무쪼록 본고를 통하여 도급 및 파견와 관련한 법리 분쟁 및 그 판단기준의 합리적 설정을 이루어, 개별 기업에서의 합리적인 운용방안을 마련할 수 있기를 기대해본다.
Abstract
Recent non-regular employment insecurity and discrimination matters was shared by all citizens in the discussion, in the political arena for the protection of the vulnerable, often cited was. In February 2012,the Supreme Court case of Hyundai Motors (Ulsan Plant) and the Hyundai Motor Company in-house subcontracting is illegal dispatch in-house subcontracting workers are determined to be seen as a full-time because of the ruled. Manufacturing in-house subcontracted workers due to the Supreme Court put an end to the debate about the legal status of labor. Order to be discussed in this paper are as follows. And look at the plan for the maintenance of non-regular employment legislation on these issues. We shall review the amendment of pagyeonbeop Contractors dispatch labor contract relationship of labor and legal issues (Ⅳ). Finally, the conclusion summarizes the results of the discussion (Ⅴ). Glad if you can find the paper to dispatch through contractors and individual companies can operate reasonably plan accordingly. Flexible employment market, in order to enhance the competitiveness of enterprises, it is necessary to also. The tripartite relationship of understanding between sharpening, and the more important labor issues, serious efforts are needed to achieve social consensus.
