법학전문대학원 수업에서 문제중심학습의 적용 사례연구

본 연구는 문제중심학습(PBL)을 법학전문대학원 실제 수업에 적용하여 법학전문대학원 수업에서 PBL 적용의 가능성과 효과성을 분석하고자 하였다. 연구의 대상 수업은 Y대학교 법학전문대학원 민사소송법을 수강하는 학생 17명을 대상으로 한 수업이었고, PBL은 15주 수업에서 적용되었으나 본 연구에 사용된 자료는 그 중 2회에 걸쳐 적용된 수업의 결과이다. 사후질문지와 심층면담을 통해 수집된 자료는 내용분석을 통하여 수업의 과정적 측면과 결과적 측면에서 분석되었다. 충분한 자료를 분석한 것이 아니어서 객관성의 면에서 다소 부족한 점이 있을 수 있겠으나(실제 수업에서 한 학기 수업 전부를 실험대상으로 삼기에는 현실적인 한계가 있었다) PBL의 적용 가능성 모색을 위한 기초자료를 제공한다는 뜻에서 제한된 자료나마 질적으로 분석한 결과는 다음과 같다. 법학 지식 수준의 차이로 인하여 학생들이 개별활동을 하면서 겪었던 어려움, 많은 시간의 요구 등 몇 가지 문제점에도 불구하고 수업의 과정적 측면에서는 학생들의 자기주도적 학습활동, 팀 토론을 통한 개인학습 한계의 극복 등 PBL의 효과를 경험하였고, 수업의 결과적 측면에서는 PBL이 학생들의 긍정적인 태도변화에 기여한 것으로 나타났다. 그 결과 많은 시간이 소요되는 점 등 몇 가지 문제점을 해결하기 위한 후속연구는 계속되어야 하겠지만, PBL은 법학전문대학원의 수업에서도 적용 가능하며 효과가 있다는 결론을 얻었다.
Abstract
This study analyzed the possibility and effectiveness of Problem-Based Learning (PBL) by applying PBL into an actual class in a law school. Seventeen law school students participated in the study, who took the Civil Procedure Code course in Y university law school. The PBL was conducted twice for 15 weeks. Data were collected through post questionnaire and depth interview and analyzed by content analysis in terms of process aspect as well as outcome aspect of instruction. The results of the study were as follows. First, from the viewpoint of the process aspect of instruction, the study showed that although they had some difficulties having different levels of legal knowledge and requiring a lot of time to solve problems, students experienced various effects of PBL, including self-directed learning and conquest of individual learning through team discussion. Second, from the viewpoint of the outcome aspect of instruction, the study showed that PBL helped students learn and contributed to the change of positive attitude. Several difficulties were discovered during the PBL process, but the study concludes that PBL is applicable to law school classes and has a positive effects on students' learning.
