소년범에 대한 경찰단계의 다이버전 활성화 방안

초록
소년사법의 궁극적인 목적은 비행청소년을 처벌이 아닌 환경의 개선과 교육에 의해 건강한 사회인으로 성장하게 하는 것이다. 이를 위해서는 소년사법에 있어서도 사법처리과정에서의 부정적 영향을 최소화하고, 그들의 인권과 복지를 보장함으로써 교정, 교화를 극대화할 수 있는 노력들이 강구되고 있다. 따라서 세계각국에서는 소년사법에 있어서 회복적 사법의 원칙과 가치를 수용하는 방향으로 개혁을 도모하고 있다. 특히, 경찰다이버전은 소년범을 조기에 형사절차에서 해방시킴으로 인해 형사절차 편입을 통한 낙인예방의 효과를 증대시키는 한편, 피해자의 피해회복을 빠르게 할 수 있다는 장점이 있는 것으로 평가되고 있다. 그러나 우리나라의 경찰다이버전 정책들은 그 법적 근거와 제도화 정도가 미흡하여 전문성 및 실효성에 있어서 한계를 노출하고 있다. 그러나 오늘의 비행청소년이 내일의 범죄인이 되지 않고 건강하고 책임있는 시민으로 성장하기 위해서는 소년사법체계의 과감한 개혁과 국가의 재정적 지원, 지역주민의 관심이 절대적 필요하다. 따라서 경찰에 대한 신뢰를 전제로 하여 다이버전의 확대 등, 소년사건처리에 있어서 경찰의 재량권 확을 넙ㄹ게 인정하는 것으로의 소년사법제도의 전환을 도모함과 동시에, 다른 한편으로서는 경찰관의 자의적인 재량권 행사를 통제하고 공정한 법집행을 담보할 수 있도록 법적 기준과 일정한 내부적 통제기준을 마련함으로써 경찰들의 적극적인 참여를 유도하여 경찰다이버전이 활성화되도록 할 필요가 있다. 이에 본고에서는 경찰다이버전으로서 현재 논의되고 있는 제도들을 중심으로 하여 경찰다이버전의 활성화를 위한 구체적 방안을 검토하고 그 대안을 제시하였다.
Abstract
One of main features of Korean criminal judicature system with respect to juvenile delinquency is that the rate of prosecution is not only lower than in adult crime but also that of non-prosecution such as suspension of indictment is respectively high. But Juvenile delinquency is increasing quantitative. Specially, there is growing the recommitted rate of juvenile offenders. The principle of juvenile protection is emphasized in the juvenile judicial system because they are mentally immature. But, some people estimate the traditional juvenile judicial system reached the limits on the ground of the growing recommitted rate of juvenile delinquents. So, in recent, some peoples advocate also the balanced and restorative justice in juvenile judicial procedure. They say this system provides a framework for systemic reform and offers hope for preserving and revitalizing the juvenile judicial system. On the other hand, some people emphasize the police’ role, as the gate-keeper of juvenile judicial procedure, in the course of treating of juvenile delinquents, and maintain to enlarge the police diversion in order to minimize the negative effect by juvenile judicial procedure. Police diversion is estimated a kind of restorative justice for juvenile delinquents. Recently, Korean Police Agency has enforced a few diversion system, professional involvement system in the police investigation, family group conferencing, conditional booking suspension system etc., as methods for preventing that juvenile delinquents recommitted. They are estimated as effective system for re-socialization of juvenile delinquents. So, in this paper, I will suggest the plans for fostering the efficiency of the police diversion.
