헌법상 행복추구권과 성년후견제도에 관한 연구

The adult guardianship system in Korea shall be implemented from July 1,2013. The purpose of this study is to find out a meaning of the adult guardianship system from the perspective of the constitutional right to pursue happiness and to examine the emergence of this system and principles of practice, the main contents. Based on this, this study proposes a preparations to implement of this system. As a study result, It was examined that the adult guardianship system has a character of social security as the constitutional right to pursue happiness. And the following contents are required : specific standards for guardians and guardianship director, a procedures on how to apply this system for a ward,standards of think reflects for a ward, prescripts to necessary for the guardian education and management, solutions to problems of cost due to the use of the system.
