우범자관리에 대한 비판적 분석

초록
범죄에 대한 공포감과 안전에의 욕망은 범죄자 처벌에 만족하지 않고, 범죄전력자는 물론범죄가 우려되는 자들을 위험한 존재로 간주하면서 이들을 식별하여 관리하기 위한 제도의 필요성을 강조하는 원인이 되어 왔다. 최근의 우범자관리 강화를 주장하는 일련의 움직임 역시 이러한 사회적 인식을 바탕에 두고 있다. 그러나 우범자관리의 사적 배경을 살펴보면 식민지배 강화를 위하여 사용된 구태의 상징이라는 사실을 확인할 수 있으며, 그 개념의 변천과정이나 성격,위험성, 형사정책과의 관계에 있어서도 다양한 문제점과 한계가 노출되고 있다. 특히 재범위험성을 제대로 평가할 기준이 불비한 상황이나 경찰이 수집하는 정보에 대한통제의 사각 등 선결되어야 할 문제들에 대해 아무런 해결방안도 제시되지 아니한 상황 아래우범자관리를 전면적으로 허용하는 것은 형사정책의 근간이자 임무인 재사회화의 목적 달성을불가능하게 하는 것으로 결코 바람직한 일이 아니다. 또한 과거와 현행 우범자관리예규 및 관련입법(안)들은 수사목적 이외에 재범방지에 기여할 수 없고, 그 목적, 정의, 종류, 선정(편입),심사와 자료 폐기 등의 절차를 검토해보더라도 규범적 지위를 허용하기에는 부적합하다는 점에서 우범자관리는 폐기되어야 할 것이다.
Abstract
Fears about crimes and the associated desires of the public have led to the emphasis on needs for a system that identifies and manages Person Liable to Committing Crime by considering them dangerous to the general public. Although the recent movement calling for stronger management of potential criminals is based on such social perceptions, the management of potential criminals is recognized as a symbol of the old tool for ancient colonial domination, presenting problems and limitations, in terms of transition, attributes, risks, and its relationship with criminal policies. In particular, amid no measures in place for existing problems, such as no criteria for proper assessment of recidivism risks and blind spots in the control of data collected by police, allowing for management of potential criminals is not desirable from the criminal policy standpoint. In addition, the laws and regulations related to potential criminals management have never served their purposes, other than investigations, and there are no regulatory justifications in terms of purpose, definitions, types, selection(inclusion), screening and material disposal. In order to execute criminal policies that support resocialization, management of potential criminals itself should be abolished.
