본고는 주권론 등장의 역사적 상황과 그 변천과정, 주권 개념에 대한 사회적 위협상황의 대두와 그 극복방안에 대한 제반 학문적 논의에 대한 검토를 통해 주권론 재구성을 위한 이론적 토대를 놓고자 한다. 이를 위해 우선 주권론 등장의 역사적 배경을 간단히 살펴보고자 하며, 다음으로 그러한 역사적 배경에 대한 검토 속에 확인되는 주권론 유지의 암묵적 전제조건을 검토해 보고자 한다. 주권관념의 위협에 대한 근래의 논의들은 바로 이러한 조건들이 침식당하고 있는 현대사회의 변화에 기인하는데 이를 짚어보는 것이 그 다음 장의 주제가 될 것이다. 이러한 토대 위에서 비로소 주권 개념, 그리고 국민주권론이 과연 현대에 의미를 상실하고 만 것인가라고 하는 물음이 다루어져야 하는데, 본고는 그 의미에 대한 여전한 긍정 속에, 과연 어떠한 재구성과 함께라면 위의 제반 위협상황에도 불구하고 (국민)주권 관념이 유지되고 자신의 역할을 수행할 수 있을 것인가의 문제를 두 개장에 걸쳐서 살펴볼 것이다. 이는 한편으로 對사회적 규율에 있어서 국가가 가지는 힘과 그것이 수행하는 역할에 대한 재고찰을 포함할 것이며, 다른 한편으로 규제적 이념으로 설정될 국민주권이라는 관념이 국가적 결정 절차들 속에서 의미를 가질 수 있는 방법은 무엇일지에 관한 새로운 이론적 탐구들에 관한 분석과 비판을 포함하게 될 것이다.
Abstract
This manuscript intends to put a theoretical basis for a reconstitution of sovereignty through the review of a whole academic discussion about the historical situation of the appearance of state's sovereignty and its transition process and the rise of social threatening situation in sovereignty concept, and overcoming solution thereof. To do this, it intends to first briefly investigate the historical background of the appearance of state's sovereignty, and examine tacit prerequisite of sovereignty maintenance which can be ascertained in the examination of historical background. Recent discussions about the threat of sovereignty concept are coming from the change of modern society in which such conditions are eroded, and to address this will be the next chapter's subject. The question asking 'Did Sovereignty concept and popular sovereignty really lose its meaning today?' must be treated on such basis. This manuscript will investigate that matter through two chapters, in the affirmative viewpoint, regarding 'can (popular) sovereignty concept be maintained and perform its role if only it accompanies with a certain reconstitution in spite of the above whole threatening situation?'. This will include reconsideration of the power that state gets in social regulation and its performing role on the one hand, and on the other hand, include analysis and criticism of new theoretical researches about what is the method, with which the popular sovereignty as regulatory idea, that can have meaning in national determination procedures.
