행정소송법개정(안)이 조세법에 미치는 영향

이 글은 2012년 5월 법무부가 새로이 마련한 행정소송법개정안을 중심으로 행정소송법의 개정이 조세법 영역에 미칠 영향에 대하여 살펴보았다. 조세법은 부과․징수권이라는 공권력을 행사하는 행정주체와 사인간의 관계를 규율하는 법체계이다. 대륙법계의 전통에 따라 공법과 사법을 준별하는 체계하에서는 이러한 법률관계에서의 법적인 분쟁은 행정소송을 통해 해결하도록 하고 있다. 그러한 점에서 조세법은 행정소송을 통해 권리구제를 수행하여야 한다는 점에서는 일반행정법과 공통요소를 공유하고 있다고 말할 수 있다. 따라서 행정소송분야의 법령 제․개정은 조세법에도 매우 중요한 영향을 미칠 수밖에 없다. 최근 법무부가 마련한 행정소송법개정시안을 통해 드러나는 개정시안의 개별 내용들은 단순히 일반 행정법에서만 중요한 의미를 가지는 것이 아니라 조세법을 포함한 모든 행정소송 관련 법영역에 중대한 영향을 미칠 수밖에 없다고 보여진다. 이와 비슷한 내용의 개정안은 2004년 10월 대법원이 마련하였던 개정의견과 관련하여 2007년 4월에 법무부가 마련해 입법예고와 공청회를 거쳐 2007년 11월 국회에 제출한 바 있었으나, 17대 국회의 임기종료와 더불어 자동폐기되어 불발로 그친 바 있었다. 2012년 5월 발표된 개정안 이후 현재는 법무부의 주도하에 2012년 말 대통령선거를 마치고 새 정부의 출범과 더불어 행정소송법개정시안을 보완한 입법예고안이 준비되고 있고, 2013년 하반기 정기국회 상정을 목표로 막바지 법제정작업이 한창이다. 본 논문에서는 이러한 추진경과를 통해 다시 수면 위에 부상한 행정소송법 개정논의에 대하여 개정시안을 중심으로 그 중 특히 조세법에 영향을 줄 수 있는 개별 주요 쟁점을 중심으로 고찰해보았다. 이를 통해 궁극적으로는 조세소송제도의 발전을 위한 바람직한 입법체계는 무엇인가에 관한 소박한 관견을 이끌어내는 것이 본 연구의 목적이다.
Abstract
This article aims at the debate on Administrative Litigations Act Amendment of 2012. Tax Law belongs to administrative law in Korea. Therefore Admini- strative Litigations Act Amendment infects directly Tax Law. Korea have not yet Tax Court and also Tax Litigations Act. First of all the Amendment will introduce the Obligations litigation. This could not introduced yet, because it could collapse with separations of powers principles. In Tax Law it becomes more important by the claims for reassessment. And other new institutions will be introduced. This reflects so many debates and discussions in these era of rule of law. But more important thing is hearing and communications among the interested academic institutions in tax law area. We need independent tax court organization and independent Tax Litigations Act. To this purpose, it must come along more heated discussion and research. Substantive tax law must form a harmony with the tax litigations law. It is hopeful that through the amendments new era of tax justice will be open.
