개인정보 국외이전에 대한 국제적 기준과 내용에 관한 고찰

구글, 페이스북과 같은 글로벌 사업자, 다(초)국적 기업 및 외국으로 개인정보가 이전됨에 따라서 정보주체의 개인정보자기결정권이 침해될 수 있는 경우에 대비한 권리보호방안을 이제 우리는 마련해야만 한다. 곧 우리는 지식정보사회에서 개인정보가 전 지구적으로 유통되거나 처리되는 상황에서 국외이전에 따른 정보주체 권리보호를 위한 추가적인 보호대책을 마련해야만 한다. 글로벌기업이나 다국적기업 및 각종 무역협정에 따른 개인정보 이전, 내국인 개인정보를 이용한 해외 침해사고 등 개인정보가 국외로 이전되거나 유출될 가능성이 증가하고 있으며, 해킹 등에 의한 개인정보 국외유출사고로부터 우리나라 국민의 개인정보를 보호하기 위한 실태조사, 클라우딩 컴퓨팅이나 RFID 등 신기술에 따른 국외이전 보호방안, 해외 유출사고 모니터링 및 침해 대응, 국외이전에 따른 각종 안전지침 및 가이드라인 등 관련 법제의 정비, 국제기구 등과 공조체계를 구축해야 한다. 따라서 우리는 글로벌 사업자 등이 개인정보를 국외로 이전하는 경우 우리나라 개인정보보호법 등의 준수여부를 검토해야만 한다. 또한 글로벌 환경 변화와 서비스 진화에 따른 개인정보보호 수준 제고를 위해 관련 학계 및 업계, 전문기관 등이 개인정보 국외이전의 위험성을 상시 검토하도록 하며 글로벌 서비스 이용과정에서 개인정보 수집ㆍ이용에 대한 법제정비, 가이드라인의 제시 등 적절한 규제체계를 마련해야만 한다. 그리고 외부적 독립기관인 개인정보보호위원회나 관련 국가기관이 글로벌 기업 등에 대한 감독과 법준수여부를 점검해야만 한다.
Abstract
Today personal information moves overseas. So that such as Google, Facebook, multinational corporation and foreign countries can obtain a variety of information about many people. Therefore the prevention of right should be prepared in case of the violation of the right to self-determination of private information. As promptly as possible, we should redesign the system of personal information security. In these circumstances, the chances of personal identity theft by global corporations, transnational corporations and various trade agreements are on the increase. For this reason, we have to research on the actual condition relating to the infringement of personal information by hacking for the protection of personal information in Korea. And we also ought to arrange for information protection method because of data spill by new technology as cloud computing, RFID. Beside we need to improve the legal system for the monitoring of the personal information oversea and the countermeasures of privacy leakage. Above all, we should build the legal system and international cooperation system for the outflow of personal data overseas like safety guide or guideline. Thus we should review whether global businessman will justify the law for our personal information protection when global corporation try to leak individual information overseas. In addition the personal information of those involved like academia, business community, specialized institution etc for the level provision of personal information protection in conformity with the change of global environment and the advance of service have to survey regularly the risk of transborder flow of personal information. Whatever we should make preparations for the appropriate regulatory system in the process of global service use like the reorganization of the system for collecting personal data and using, the suggestion of guideline etc. And personal information protection committee which is an independent organization or state organ should go over issues regarding the supervison and law abidance of global companies.
