국민기초생활보장수급자 선정을 위한 부양의무자 기준의 개선방안에 관한 연구: 판례분석을 중심으로

초록
국민기초생활보장법의 급여는 국민의 생존을 보장해주는 최후의 사회적 보장이다. 이러한 중요성에도 불구하고 부양의무자 기준으로 인해 실제로 보호받아야 하는 수급자를 탈락시키고 있어 빈곤가족에 대한 사회적 책임을 가족에게 넘기고 있다는 비난을 받고 있다. 따라서 공공부조로서 국민기초생활보장법이 제대로 기능하기 위해서는 부양의무자 기준이 수정되어야 한다. 특히 부양의무자가 있어도 ‘부양을 기피하거나 거부하는 경우’로 인해 부양을 받을 수 없는 경우는 그 기준이 구체적이지 않아 보장기관의 재량권에 의해 좌우될 여지가 크다. 이에 본 연구는 이와 관련된 국민기초생활보장법 부양의무자 기준의 법적 근거를 알아보고 이와 관련된 판례를 분석함으로써 이에 대한 개선방안을 찾아보았다. 그 결과 개선방안으로 첫째, 부양을 기피하거나 거부하는 경우에 대한 구체적인 기준이 명시되어야 하며, 두 번째 사회복지소송을 위한 특별소송 절차나 사회법원 마련이 필요하며, 마지막으로 장기적으로는 부양의무자 기준과 관련된 원칙이 수정되어야 함을 밝혔다.
Abstract
They payment from National Basic Living Security Act is the last social security to guarantee individual’s survival. Despite the high degree of its importance, it is under fire since the recipients who must be protected are excluded because of family support obligation rules, passing the social responsibilities of poverty to the families. Therefore, as public aid, there must be revision on the family support obligation rules for the National Basic Living Security Act to function properly. Under the family support obligation rules, the article, “the case of rejecting and avoiding support” is unclear, so the institution has a right to decide. Thus, the study will find the legal evidence of the family support obligation rules based on the National Basic Living Security Act and finds out how to improve based on the recent case studies. As a result, firstly, when avoiding and rejecting family support, the detailed criteria must be indicated, secondly for the lawsuit regarding social welfare, the special legal process or the Social Community must be formed and lastly, the principle and regulation on the family support obligation must be revised in a long-term.
