유럽 연합 친권법 원칙과 한국 친권법 비교연구

The discussion in this paper is about a comparative study of EU and Korea in parental responsibilities, this study is for developing korean parental rights law. Principles of European Family law Regarding Parental Responsibilities were regulated by the Commission on European Family Law in 2007. the principles were focused on autonomy of the child and responsibilities of the parents for children. Most of all, Best interests of the child is the primary consideration. Parental responsibility is legal responsibility for a child and the right to be involved in key decisions about parent's upbringing. Most European countries recognize that children have the right to a personal relationship and direct contact with both parents. A child is associated with its parent, and its right's is primarily protected by its parent. The decision-making of parents about the child can be justified by the best interests of the child, and may be restrained by the welfare of the child. The purpose of the restraint is the promoting of the welfare of the child. Korean parental rights law with Principles of European Family Law will be the more advanced law in parental responsibilities.
