경성제대 공법학자들의 빛과 그림자

초록
지금까지 경성제국대학에 관한 연구는 대학설립의 동기와 과정, 근대 고등교육의 발전, 경성제대 졸업생의 인생행로와 해방 후의 역할 등 대학의 기구와 제도 그리고 졸업생의 활동에 초점을 맞춘 것이 대부분이었다. 이 연구는 경성제국대학 법문학부를 움직인 주체, 즉 교수진의 인간적인 면모와 연구 활동의 결과 그리고 조선인 졸업생에게 미친 영향을 공법학 교수를 중심으로 살펴본 것이다. 공법학자로서는 淸宮四郞, 尾高朝雄 그리고 鵜飼信成 세 사람을 중심으로 1945년 패전하고 귀국할 때까지의 행적을 조선인 학생들의 회고를 중심으로 검토하였다. 연구 결과 淸宮은 『外地法硏究』를 비롯한 여러 논문에서 메이지 헌법의 무흠결 완전성과 불변성을 믿고 이를 강조했으며, 한스 켈젠의 번역과 해석 이의 추종에 심혈을 기울였다. 尾高 역시 일본제국주의의 조선 식민지화와 소위 내선일체 등 조선과 대륙침략의 이론적 기초를 마련하는데 혈안이 된 사람으로 철학 없는 법철학자로 간단히 평가를 내릴 수 있다. 鵜飼는 이른바 천황기관설 사건의 와중에서 교수가 되었기 때문에 매우 조심스럽게 연구 활동을 하였으나 나치스 어용법학자인 칼 슈미트 연구, 나치스 법치주의, 조세법 등에 주력하고 행정법연구로 자신의 정체를 감추려고 하였다. 그 역시 계엄령해설과 징발 문제 등으로 시류에 편승하여 일본제국주의의 국가정책에 적극 협력하였다. 전체적으로 경성제대의 공법교수들은 국가 정책에 부응하는 연구와 켈젠을 맹목적으로 받든 독일숭배주의의 사대주의법학자로서 공통된 특징을 지녔다. 또 이들이 조선인 학생들에게 미친 영향은 법학에서의 일제청산이란 점에서도 매우 중요한 것이며, 민주주의의 역사가 일천하고 국수주의 학문을 애국으로 오해하고 포장하는 일본인에게 우리들 한국인 학자들은 동아시아에서의 평화와 안정 그리고 참다운 학문적 자세를 위해서도 객관적이고 냉정한 연구가 무엇인지 가르쳐줄 의무가 있는 것이다.
Abstract
In this Article the author attempt to analyse and describe systematically the influence and impact of the scientists of public law at Keijo Imperial University upon Korea. In chapter II, we examine the prehistory of legal education in Korea before Keijo Imperial University. In chapter III, we trace the persons and activities of the member of faculty of Law and Literature. In chapter IV, we examine especially professors of public law, Tatsu Izumi, Shutaro Matsuoka, Siro Kiyomiya, Nobuyoshi Ugai and including Tomoo Otaka who studied German theory of state. The author emphasize the representative three professors, Kiyomiya, Otaka and Uagi. As the result of this study, we knew that Kiyomiya was one of the trumpeter of Japanese imperialism, Otaka theorist for the fascism, philosopher without philosophy, Ugai weak intelligence of curried favor with the public during World War II. Also they were interpreters and followers of Kelsen's Pure Theory of Law. Naturally they influenced upon Korean students idea and activities. In order to establish East Asian peace and stability we have to eliminate Japanese antidemocratic thought and academic remnants of bureaucratic science of law.
