초록
최근 무역기술장벽으로 인한 통상마찰이 심화되고 있어 이를 효과적으로 규율하기 위한 WTO TBT협정의 적극적인 운용이 요구되고 있다. 그러나 TBT협정에 관한 기존 연구는 많지 않으며 관련 분쟁 판례 및 법적 발전 역시 미미한 실정이다. 이러한 배경에서 본 연구는 그동안 많은 연구가 이루어지지 못하였던 TBT협정에 관하여, 그 제도적 발전과정, 법적 운용 및 이행상의 문제점을 검토하고 향후 발전과제를 제시하는데 목적을 두고 있다. GATT/WTO체제에서 기술장벽 문제를 포괄적이고 체계적으로 다룰 수 있는 법규범과 제도 마련의 필요성은 오래 전부터 꾸준히 제기되어 왔으며 동경라운드 이후 TBT협정은 끊임없는 제도적 발전을 이루었다. 특히 협정의 적용범위가 지속적으로 확대되고 중요한 규정들이 구체화되는 등 무역기술장벽 문제를 규율하는 국제규범으로서의 면모를 갖추어가고 있다. 그러나 TBT협정은 법제도적 측면에서 모호성이 크며 그 결과 운용상의 근본적인 한계가 주목된다. 동 협정은 대부분이 절차적 규정으로 이루어졌고 구체적인 설명 없이 일반적 의무만을 규정하는 조항이 많아 그 해석과 이행에 있어 많은 어려움을 야기하고 있다. 최근 TBT분쟁에서는 TBT협정의 주요 규범에 관하여 상소기구 검토가 최초로 이루어져 판례로서의 의미가 크다. 특히 TBT협정의 내국민대우원칙 및 최소무역제한 원칙이 GATT상의 규범과 어떠한 일관성을 가지며 동시에 어떻게 구별되어야 하는지에 관한 검토기준을 제시하였고 기술규정의 ‘강제성’ 개념을 사실상 광범위하게 해석하여 TBT협정의 실질적인 적용범위를 확대시켰다. 이러한 법적 발전은 TBT협정의 실질적인 유용성을 제고한 것으로 평가된다. 향후 TBT협정의 안정적이고 효과적인 운용을 위해서는 이행 수준이 제고되어야 할 것이며 무역기술장벽과 관련된 통상 마찰을 해소하기 위하여 TBT위원회의 역할이 보다 적극적으로 수행되어야 할 것이다.
Abstract
Recently, technical barrier to trade has become one of the most important non-tariff barriers to trade and under the current multilateral trading system, trade conflicts related to this technical barriers are ever-rising. However, the WTO Agreement on Technical Barriers to Trade (the TBT Agreement) governing unnecessary trade barriers resulted from technical barriers, which the Agreement identifies as technical regulations, standards and their conformity assessment procedures, has not been actively invoked and applied for settling disputes. Moreover, its implementation faces many practical difficulties as a result of the Agreement's legal ambiguity and jurisprudence. This article basically identifies these challenges for the future development of the TBT Agreement by focusing on the legal issues related to the interpretation and application of the TBT Agreement. The article first overviews how the GATT/WTO TBT system has developed, emphasizing its successful expansion of legal scope and enhancement of major norms and regulations. Then, it analyses practical problems faced by the WTO Members in actually implementing the Agreement. The system's legal uncertainty, diversity in the level of Members' technical and economic capacity, as well as ineffective domestic system are major important factors for low and inconsistent implementation. Last, it analyses some major legal issues raised in recent TBT dispute cases and discusses their implications for the future development of the Agreement's jurisprudence. It specifically notes that the dispute rulings have provided important guidelines or principles for clarifying the coherence as well as distinction between GATT principles of national treatment and least-trade restrictiveness and those principles embedded in the TBT Agreement. Furthermore, the article also emphasizes the important implication of the Appellate Body's interpretation of 'mandatoriness' for defining technical regulations since it has, in fact, widened the legal scope of Article 2 and, thus, that of the TBT Agreement.
