최근 우리 사회에서는 뚜렷한 동기를 파악하기 어려운 범죄들이 계속 급증하고 있어 국민적인 불안이 증가하고 이에 대한 자료축적과 분석 및 대책마련이 시급한 실정이다. 그런데 이러한 동기를 파악하기 어려운 범죄들은 대부분 정신의학적 측면에서 여러 가지 문제를 가진 범죄자들이 대부분이다. 반복적인 범죄를 저지르는 반사회성 성격장애 또는 사이코패스와 같은 유형들이 그 예이다. 따라서 이러한 범죄에 대하여는 정신의학적 또는 범죄심리학적 접근이 필수적이다. 그러한 이상심리를 가진 범죄자들은 자신의 이익을 위해 서슴없이 거짓말을 행하며, 타인의 권리를 침해하는 데 양심의 고통을 느끼지 않는 특성을 가진 경우가 많은데 이러한 부분에 대한 사전 지식이 없는 수사관은 피의자들의 진술에 농락을 당할 가능성이 있으며, 범죄자의 특성을 파악하지 못하면 제대로 된 수사와 적정한 양형을 기대하기 어렵다. 그러나 현재 검찰 수사관과 검사에 대하여 이러한 부분에 대한 교육이 전혀 없으므로 교육이 시급히 필요하고, 자료를 축적함에 있어서도 정신의학적 분석이 가능하도록 하여야 하며, 교정에서도 상담치유가 지속적으로 이루어져야 한다.
Abstract
The recent dramatic increase in crimes of which clear motivations are hard to find is generating nationwide anxiety, so that there is pressing need for data collection, analysis, and countermeasures of these crimes. This type of crimes is mostly committed by criminals who have psychiatric disorders. Notable examples are antisocial personality disorders or psychopathy that results in repeated crimes. Therefore, psychiatric or criminal psychological approaches are necessary in dealing with these crimes. Criminals with these disorders lie for their personal interest without any hesitation and do not feel guilty for infringing others' rights, and investigators without knowledge on these properties are likely to be trifled with, in which case pertinent investigation and appropriate sentencing cannot be achieved. However, there is no training for investigators and prosecutors on these issues at the moment. Education is urgently needed. Psychiatric analysis in data collection shall be available, and counseling must be continued in the correction process.
