초록
친기업 정책을 통한 대기업 성장이 낙수 효과의 기대와 달리, 소상공인과 중소기업의 생존 무대마저 빼앗아 가고 있다. 특히 대기업이 골목상권, 심지어 순대나 떡볶이 등 서민의 업종까지그 범위를 확대하고 있고, 중소기업이 기술혁신을 통하여 성장시켜 놓은 내비게이션 시장까지침투하고 있다는 보고가 잇따르고 있다. 정부가 제조업에서 대기업을 우선시하는 정책을 펼친것은, 무엇보다도 외국 다른 기업들과의 경쟁력을 키워 국가경제를 기여하고자 한 것이다. 이 점을 고려한다면 대기업은 국내의 소상공인이나 중소기업을 상대로 하여 경쟁을 하는 것보다, 눈을돌려 외국과의 경쟁에 박차를 가해야 할 것이다. 중소기업 적합업종지정제도가 실효성을 창출해 낼 수 있는가에 의문이 제기되고 있다. 동반성장위원회의 중소기업적합업종 지정이 대·중소기업 간 협의에 따른 ‘권고사항’일 뿐 법적 구속력이 없기 때문이다. 실질적 효과가 나타나기 위해서는 특별법을 제정할 필요성이 있다는 주장, 이행명령 및 위반 시 영업정지․벌금 등 법적 제재를 명시화하자는 주장 역시 제기되고 있는 상황이다. 그러나 동반성장위원회가 법적으로 민간 자율기관에 해당하다는 점에서, 동 기관에 제재권한을 부여하는 것이 적정한가의 문제 역시 제기되고 있다. 특히 논란이 되고 있는 사항은 제과점․음식점 등 서비스 업종에 대한 중소기업 적합업종지정의 도입이다. 제과점·음식점 등이 중소기업 적합업종으로 지정된 이유는, 지난 수년간 대기업이 생계형 서민 서비스 업종에 무차별적으로 진입했기 때문이다. 프랜차이즈에 대한 중소기업 적합업종제도의 도입이 타당한가에 대하여는 의문이 있다. 떡볶이, 순대 및 김밥 등은 동네빵집의 골목상권을 구성하면서 제빵시장은 더 이상 동네빵집과 프랜차이즈 빵집 간에 경쟁구도가 아니라 완전경쟁시장 구도라고 볼 수 있다. 동네빵집의 몰락원인이프랜차이즈 빵집의 확장 때문이라고 하는 주장이 있지만, 프랜차이즈 빵집이 늘어나는 것은 제과에 대한 소비패턴의 변화와 제품의 다양성, 위생 및 서비스 등 소비자 후생에 따른 결과라고 주장이 제기되고 있는바, 프랜차이즈 산업과 같은 서비스 업종에서는 제조업과 달리 판단의 필요성이있다.
Abstract
This article analyzes legal issues of small and medium-sized business being selected, including the regulation of franchise industry. The conflict between great and small, medium-sized businesses is aggravated this day. There ware conflicts among great, small and medium-sized businesses in manufacturing. The government selected the items of the consultative group by analyzing and investigating the actual conditions. Suitable business type designation in the service industry will involve designation with priority on business type that are experiencing social conflicts. However, it is questionable that National commission for Corporate Partnership considers small and medium-sized business being selected by in the service(franchise) industry. The franchise industry is contributing to the strengthening of competitiveness through the economy of scale by organizing existing individual proprietors and increasing the success rate of new businesses. And domestic franchise businesses are hard pressed to secure competitiveness with multinational overseas franchise corporations that are operating in Korea. The system may difficulty for domestic franchise business in securing international competitiveness. It is necessary to establish in the domestic franchise industry an environment where a global franchise corporation is capable of growing. The system that do not consider the process or background of the growth of franchise business must be removed. Therefore the suitable business type system should not hinder great corporations.
