사회복지국가실현과 헌법 -사회국가의 헌법적 의무와 그 실현을 중심으로-

초록
본고는 최근 정치권에서 중요하게 논의되고 있는 복지정책과 관련하여 선결되어야 할 과제에 관한 논의를 중심으로 하였다. 국가의 복지정책 및 그 추진은 헌법의 명령으로서 국가는 헌법의 지침에 따라서 이를 이행하여야 한다. 그러나 헌법적 명령에 따른 국가의 사회복지실현은 헌법이 이에 관한 모든 사항을 구체적으로 명시하고 있지 않음에 따라 여타 헌법규범과 관련하여 체계적인 해석을 통하여 구체화의 작업이 선결되어야 한다. 사회국가의 복지실현에 있어서 해결되어야 할 선결과제는 사적 영역 중에서 어떠한 영역을, 어떠한 방법으로, 어떻게(또는 무엇을 통해서) 행할 것인가 하는 것이다. 이러한 문제의 해결을 위하여는, 우선 헌법이 규정하고 있는 명령의 내용을 검토할 필요가 있다. 우리헌법은 사회국가실현에 대한 명령으로서 기본권형태로서 구체화하고 있으며, 그에 따른 사회국가의 헌법적 의무는 사회적 정의, 사회적 안전, 사회적 통합 등을 통하여 실질적 자유와 평등 실현의 내용으로 구체화된다. 이러한 내용의 사회국가의 헌법적 의무를 이행하기 위하여, 우선 그 복지영역의 설정이 선결되어야 한다. 복지영역의 설정은 헌법의 여타 의무와 관련하여 실질적 자유와 평등실현을 위하여 시대적으로 요구되는 영역으로 결정되어야 한다. 그리고 선택된 영역에 대한 방법은 사회국가실현의 방법적 한계로서 보충성의 원칙이 결정적인 선택기준이 된다. 이에 따라서 보면 선별적 이행이 타당하다. 그리고 복지실현을 위한 복지재정의 확충은 과세의 수단을 동원하되 응능부담의 원칙에 입각하고, 경기부양책으로 운영해 오고 있는 감세 및 비과세정책을 복지실현과 비교형량을 통하여 축소하는 방법을 통하여 확충하는 방법이 고려될 수 있다. 그리고 무분별한 복지정책을 위하여 복지비용상환제의 도입도 필요한 제도 중의 하나라고 본다.
Abstract
It is the realization of welfare which is the best important one of recently political issues in korea. The extension of welfare as the one of realization of welfare has to be made in the frame of constitution. These binding of constitution in the realization of welfare state results in the prevision of constitution which is prescribed in most modern state-constitution. These constitutional prevision for the doctrine of social state is prescribed in the constitution of korea. The extension of welfare in korea has to get accomplish in accordance with the social prevision of constitution. It is necessary in oder to realize the welfare that is of the financial support of state. If there is no financial support of state, it is no use of the realization of welfare and it means just only formal action of state. The financial affaire of state depends on the tax of the nation. It is very important to fulfill these problems of constitution in order to accomplish the realization of welfare state. In this paper this problems is investigated and also the direction for them is submitted.
