초록
‘다문화사회’를 알아가는 과정은 곧 인간에 대한 이해의 폭을 넓혀가는 길이기도 하다. 법은 그 앎과 이해의 또 다른 반영이다. 이 글은 우리의 바람직한 다문화사회의 정초를 위해 요구되는 법제와 인권 패러다임의 변화를 모색하기 위한 목적으로 쓰였다. 현재 급속하게 축적되고 있는 우리 사회의 다문화 현상에 대한 지표는 다문화사회를 바라보는 좋은 이해 방법이 될 수 있다. 더불어 그에 비례한 이면의 시각 또한 다문화사회 속의 한 작용이 될 수 있고, 이 또한 현실임은 물론이다. 이를 바탕으로 다문화사회의 법제와 인권의 구체적인 기술을 통해 현대의 우리 사회에서 요구되는 가치를 창출해 보고자 한 시도가 이 글인 셈이다. 한국 사회의 다문화적 특수성을 감안할 때 우리가 쓰고 있는 ‘다문화’에 대한 이해의 요소, 즉 그 대상과 내용, 그리고 접근방식 등에 대해서는 더 많은 고려와 논의가 필요하다고 본다. 특히, 다문화사회가 사회적 약자를 향해 가해지는 내부의 문제를 다루기 위한 시험의 장이 되게 해서는 안 된다. 따라서 가파르게 진행되고 있는 우리 사회의 다문화 현상에 따라 역으로 새로운 취약계층으로 전락하고 있는 다문화가족의 공동체를 복원하고 껴안기 위해서라도 쓰임이 같고 지속적인 공감대가 형성될 수 있는 법제의 마련도 시급하다. 그럴듯한 교육 기회와 우리 문화에의 접근 기회를 다문화가족에게 제공해주는 것만으로는 부족하다. 인권의 힘은 법의 변화를 추동한다. 사회 구성원 간의 원활한 소통과 화합은 그 자체가 한국이 다문화사회로 연착륙하기 위해 반드시 거쳐야 하는 조건이다. 날로 증가하고 있는 다문화가족의 목소리를 대변하고, 이들과 소통할 수 있는 열린 장이 마련되어야 하는 것도 그 때문이다. 이는 인권의 궁극적 요소로 함께 사는 행복한 사회 구현에도 이바지할 수 있을 것이다. 다문화사회의 질서는 우리의 역사에도 잠재되어 있다. 우리에게 다문화사회는 무규칙적이고 혼종화한 미지의 영역이 아니었다. 다문화사회만을 외따로 사유할 마땅한 이유를 찾기 힘들었던 것이다. 오히려 시대의 흐름에 빚져 전개되는 사회 현상이 문제이다. 다문화가족이 한국 사회 구성원으로 안착할 수 있도록 우리 전통에 견주어도 전혀 손색없는 제도를 선보이기 위한 노력은 언제나 현재진행형이어야 한다. 다문화사회로의 과정에서 제기된 문제는 -적어도 형식적인 면에서는- 의외로 단순할 수도 있다. 누구나 쉽게 접근이 가능한 논의가 촉진되어야 한다. 좋은 문제 제기도 포함된다. 이 글 또한 그에 작은 기여라도 할 수 있기를 기대한다.
Abstract
The process of getting to know ‘Multicultural Society’ is another way of broadening and deepening our understanding of human beings, whereas a law is a different reflection of the knowing and understanding of them. The purpose of this study was to seek the legislative system required for laying the corner stone of desirable multicultural society and the changes of human rights paradigm. Currently, rapidly accumulating index of multicultural phenomenon in our society can be a great way of understanding multicultural society. In addition, the hidden side of this point of view can be possibly one operation within multicultural society and that is, of course, a reality we are facing now. Thus, detailed description of the legislative system of the society and human rights based on those points of view is one of the intentions of this study, creating required values in modern society. Considering distinctiveness of multicultural feature in Korea, more discussions and consideration should be on the factors of ‘multiple cultures’—the object, contents, and method of approaching. In specific, it should be avoided that multicultural society becomes a place where internal problems which are made against social minorities are addressed. Therefore, it is urgently needed to prepare a legislative system with the same use, creating continuous bond of sympathy at least to restore and embrace community of multicultural family, which has been degraded to emerging social minorities through showing sharply increasing multicultural trend in Korea. It is not enough to provide a plausible opportunity of education and access to our culture for multicultural family. Good communication and harmony among members of a society are a rite of passage toward soft landing on multicultural Korean society. Therefore, it is necessary to speak for the increasing voices of multicultural families and to arrange an open place for better communication, which eventually may contribute to build a happy society where everyone lives together. In fact, the order of multicultural society has been embedded in our history; it was far from being random or mixed unknown area but rather there was no reason to think a multicultural society as a separate one. It is a social phenomenon more against the stream of times. The effort to establish multicultural family as a member of Korean society should be continued, able to stand comparison with our tradition. In addition, problems occurred on the process of being a multicultural society can be simpler than we may think at least in reference to form. Easy access to discussion should be promoted so that anyone can approach, which includes pointing out a good issue as the purpose of this study hope to fulfill at least some of them.
